The impact on business-related human rights protections is therefore equally uncertain, with multiple political factions in play. The Conservatives of the <a rel=\"noreferrer noopener\" aria-label=\"European Research Group (opens in a new tab)\" href=\"https:\/\/www.conservativehome.com\/tag\/european-research-group\" target=\"_blank\">European Research Group<\/a> are hard-line Eurosceptics, seemingly willing to accept a no-deal Brexit, and supportive of extreme deregulation post-Brexit. Labour has a sizeable remain and soft Brexit grouping, while some favour <a rel=\"noreferrer noopener\" aria-label=\"Lexit (opens in a new tab)\" href=\"https:\/\/www.brexitblog-rosalux.eu\/2019\/02\/12\/their-internationalism-and-ours\/\" target=\"_blank\">Lexit<\/a>, a left-wing Brexit to allow more freedom to implement social policies. The recent <a href=\"https:\/\/www.theguardian.com\/commentisfree\/2019\/feb\/24\/observer-view-on-the-independent-group\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"pro-remain desertions (opens in a new tab)\">pro-remain desertions<\/a> from the major parties is another complicating factor. This blog will describe some plausible business-related human rights risks domestically and internationally, on the assumption of a Conservative-led Brexit occurring.<\/p>\n\n\n\n<p>Domestically, workers\u2019 rights are extremely vulnerable. Boris Johnson argued in 2012 that Britain should \u2018<a rel=\"noreferrer noopener\" aria-label=\"scrap the Social Chapter (opens in a new tab)\" href=\"https:\/\/www.independent.co.uk\/news\/uk\/politics\/boil-it-down-to-the-single-market-boris-johnson-calls-for-eu-referendum-8381456.html\" target=\"_blank\">scrap the Social Chapter<\/a>\u2019 that protects workers\u2019 rights including parental leave and equal opportunities, and more recently that the \u2018<a rel=\"noreferrer noopener\" aria-label=\"weight of employment regulation is now back-breaking (opens in a new tab)\" href=\"https:\/\/www.express.co.uk\/news\/politics\/495970\/Boris-Johnson-says-Britain-could-have-good-future-outside-European-Union\" target=\"_blank\">weight of employment regulation is now back-breaking<\/a>\u2019. Priti Patel has criticized the Agency Workers Directive, while many Tories have criticized the <a rel=\"noreferrer noopener\" aria-label=\"Working Hours Directive (opens in a new tab)\" href=\"https:\/\/www.independent.co.uk\/news\/uk\/politics\/brexit-safety-standards-workers-rights-jacob-rees-mogg-a7459336.html\" target=\"_blank\">Working Hours Directive<\/a>, including Dominic Raab, previously Brexit Minister. Jacob Rees-Moog has stated that \u2018<a rel=\"noreferrer noopener\" aria-label=\"a Conservative government may wish to reduce [employment rights (opens in a new tab)\" href=\"https:\/\/www.youtube.com\/watch?v=SKAcdD48B6U\" target=\"_blank\">a Conservative government may wish to reduce [employment rights<\/a>\u2019.<\/p>\n\n\n\n<p>A second important topic is safety, including health and safety at work and food regulations. A trade deal with the US may require permitting numerous practices, such as <a rel=\"noreferrer noopener\" aria-label=\"chlorinated chicken (opens in a new tab)\" href=\"https:\/\/www.cieh.org\/media\/blog\/2018\/7-threats-to-food-safety-after-brexit\/\" target=\"_blank\">chlorinated chicken<\/a>, banned in the EU. <a rel=\"noreferrer noopener\" aria-label=\"Liam Fox (opens in a new tab)\" href=\"https:\/\/www.independent.co.uk\/news\/uk\/politics\/brexit-liam-fox-chlorinated-chicken-no-objection-people-eating-trade-eu-talks-uk-leave-a8031146.html\" target=\"_blank\">Liam Fox<\/a>, as trade minister, voiced support for deregulation, under the guise of \u2018giving the public a choice over what they are eating\u2019. For <a rel=\"noreferrer noopener\" aria-label=\"Rees-Mogg (opens in a new tab)\" href=\"https:\/\/www.independent.co.uk\/news\/uk\/politics\/brexit-safety-standards-workers-rights-jacob-rees-mogg-a7459336.html\" target=\"_blank\">Rees-Mogg<\/a>, \u2018there\u2019s a very long way you can go in rolling back emissions and safety standards.\u2019 <a rel=\"noreferrer noopener\" aria-label=\"Banking deregulation (opens in a new tab)\" href=\"https:\/\/www.ihrb.org\/focus-areas\/finance\/prof.-john-ruggie-comments-on-the-thun-group-of-banks\" target=\"_blank\">Banking deregulation<\/a>,<a rel=\"noreferrer noopener\" aria-label=\" pro-business tax arrangements (opens in a new tab)\" href=\"https:\/\/www.cambridge.org\/core\/journals\/business-and-human-rights-journal\/article\/elephant-in-the-room-corporate-tax-avoidance-business-and-human-rights\/1D615D47FB0632DCFE365DB10F07ACF7\" target=\"_blank\"> pro-business tax arrangements<\/a> and <a href=\"https:\/\/tbinternet.ohchr.org\/_layouts\/treatybodyexternal\/Download.aspx?symbolno=E%2fC.12%2fGC%2f24&amp;Lang=en\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"increased privatization (opens in a new tab)\">increased privatization<\/a> all pose risks to human rights protection.<\/p>\n\n\n\n<p>Internationally, the severe economic risks of Brexit may encourage <a rel=\"noreferrer noopener\" aria-label=\"bilateral investment treaties (opens in a new tab)\" href=\"https:\/\/www.law.cornell.edu\/wex\/bilateral_investment_treaty\" target=\"_blank\">bilateral investment treaties<\/a> (BITs) that include significant inducements to investors, including weaker human rights protections. <a rel=\"noreferrer noopener\" aria-label=\"Extraterritorial jurisdiction (opens in a new tab)\" href=\"https:\/\/www.cambridge.org\/core\/journals\/business-and-human-rights-journal\/article\/home-state-duty-to-regulate-the-human-rights-impacts-of-tncs-abroad-a-rebuttal\/B292F0D2EB7E40152011F3B0D42E96FE\/core-reader\" target=\"_blank\">Extraterritorial jurisdiction<\/a> over UK companies operating abroad could be limited, with <a rel=\"noreferrer noopener\" aria-label=\"forum non conveniens (opens in a new tab)\" href=\"https:\/\/www.jstor.org\/stable\/3663407?seq=1#page_scan_tab_contents\" target=\"_blank\">forum non conveniens<\/a> possibly returning if the <a rel=\"noreferrer noopener\" aria-label=\"Recast Brussels Regulation (opens in a new tab)\" href=\"https:\/\/eur-lex.europa.eu\/LexUriServ\/LexUriServ.do?uri=OJ:L:2012:351:0001:0032:En:PDF\" target=\"_blank\">Recast Brussels Regulation<\/a> is not carried over. <a rel=\"noreferrer noopener\" aria-label=\"Access to remedy (opens in a new tab)\" href=\"https:\/\/www.ohchr.org\/EN\/NewsEvents\/Pages\/DisplayNews.aspx?NewsID=22250&amp;LangID=E\" target=\"_blank\">Access to remedy<\/a> could suffer as this regulation also guarantees the <a rel=\"noreferrer noopener\" aria-label=\"enforceability of judgements (opens in a new tab)\" href=\"http:\/\/hoganlovellsbrexit.com\/blog\/the-impact-of-brexit-on-the-enforcement-of-judgments-between-the-uk-and-eu-member-states-post-brexit\" target=\"_blank\">enforceability of judgements<\/a> between member states. Strengthening of the <a rel=\"noreferrer noopener\" aria-label=\"Modern Slavery Act (opens in a new tab)\" href=\"http:\/\/www.legislation.gov.uk\/ukpga\/2015\/30\/contents\/enacted\" target=\"_blank\">Modern Slavery Act<\/a> and the <a rel=\"noreferrer noopener\" aria-label=\"National Action Plan on Business and Human Rights (opens in a new tab)\" href=\"https:\/\/www.gov.uk\/government\/publications\/bhr-action-plan\" target=\"_blank\">National Action Plan on Business and Human Rights<\/a> can be assumed to be deprioritized in a deregulatory political climate. The UK would also not be party to a mooted overarching <a href=\"https:\/\/www.asktheeu.org\/en\/request\/5570\/response\/18000\/attach\/html\/15\/Business%20and%20Human%20rights%20report%20final.pdf.html\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"EU National Action Plan (opens in a new tab)\">EU National Action Plan<\/a> on Business and Human Rights.<\/p>\n\n\n\n<p>Various EU <a rel=\"noreferrer noopener\" aria-label=\"transparency and human rights due diligence policies (opens in a new tab)\" href=\"https:\/\/www.ohchr.org\/Documents\/Issues\/Business\/WGSubmissions\/2018\/EU.pdf\" target=\"_blank\">transparency and human rights due diligence policies<\/a> could also be abandoned. The <a rel=\"noreferrer noopener\" aria-label=\"EU Directive as regards disclosure of non-financial and diversity information by certain large undertakings (opens in a new tab)\" href=\"https:\/\/ec.europa.eu\/info\/business-economy-euro\/company-reporting-and-auditing\/company-reporting\/non-financial-reporting_en\" target=\"_blank\">EU Directive as regards disclosure of non-financial and diversity information by certain large undertakings<\/a> and groups of undertakings requires public-interest companies with more than 500 employees to disclose relevant information \u2018relating to, as a minimum, environmental matters, social and employee-related matters, respect for human rights, anticorruption and bribery matters.\u2019 The <a rel=\"noreferrer noopener\" aria-label=\"EU Timber Trade Regulation (opens in a new tab)\" href=\"http:\/\/ec.europa.eu\/environment\/forests\/timber_regulation.htm\" target=\"_blank\">EU Timber Trade Regulation<\/a> prohibits the sale of illegal timber and obliges operators relevant firms implement a due diligence system to ensure compliance. The <a rel=\"noreferrer noopener\" aria-label=\"EU Regulation on conflict minerals (opens in a new tab)\" href=\"http:\/\/ec.europa.eu\/trade\/policy\/in-focus\/conflict-minerals-regulation\/regulation-explained\/\" target=\"_blank\">EU Regulation on conflict minerals<\/a> adopted in 2017 defines supply chain due diligence obligations for importers of tin, tantalum and tungsten, their ores, and gold originating from conflict-affected and high-risk areas. The <a rel=\"noreferrer noopener\" aria-label=\"EU Directive on Public Procurement (opens in a new tab)\" href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=celex%3A32014L0024\" target=\"_blank\">EU Directive on Public Procurement<\/a> also includes transparency requirements. Other EU-led BHR-related projects include the <a rel=\"noreferrer noopener\" aria-label=\"sustainable finance action (opens in a new tab)\" href=\"https:\/\/ec.europa.eu\/info\/publications\/180308-action-plan-sustainable-growth_en\" target=\"_blank\">sustainable finance action<\/a> plan, promoting the <a rel=\"noreferrer noopener\" aria-label=\"SDGs (opens in a new tab)\" href=\"https:\/\/ec.europa.eu\/europeaid\/policies\/sustainable-development-goals_en\" target=\"_blank\">SDGs<\/a>, and the <a href=\"http:\/\/www.europarl.europa.eu\/RegData\/etudes\/STUD\/2017\/578031\/EXPO_STU(2017)578031_EN.pdf\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"UNGPs (opens in a new tab)\">UNGPs<\/a>.<\/p>\n\n\n\n<p>Despite the looming deadline, post-Brexit policies remain unknown.
