Summary

Toshiki Mogami, in chapter 1, reviews the contributions and the so far unnoticed limits of Global Constitutionalism. Being apparently so new, this theory has been highly esteemed as truly innovative. Was it, however, wholly innovative, in terms of either its power to explain facts or its capability to prescribe a design for the future? Mogami casts doubt on this estimation and shows that there was a predecessor to Global Constitutionalism, which deserves to be remembered and referred to. At the same time, the chapter calls attention to the theoretical validity of the conventional concepts of multilateralism, and after enriching multilateralism normativaly, it connects this ‘normative multilateralism’ with the concept of critical constitutionalism, and presents ‘normative multilateralism’ as a viable alternative for the survival of Global Constitutionalism.
