Appendix E - The GM “Side Saddle” Truck Litigation

Summary

In Moseley v. General Motors Corp., a case involving a death that allegedly resulted from a truck with a side-mounted gas tank outside the frame rails, a jury awarded $105 million to the plaintiff – $101 million of that award was for punitive damages. The plaintiffs' attorney had urged the jury to grant punitive damages of $100 million, $20 for each such truck on the road, to force GM to recall these five million trucks. In closing arguments, he told the jury: “We want it recalled and we want a punitive damage verdict that makes it virtually impossible not to recall it.” The jurors agreed: “I hope they'll read this verdict and make it right. They need to recall the trucks,” said one juror. “We added the extra million to let General Motors know how strongly we felt,” said another.
