  • In Law and Inhumanity, Luigi Corrias explores fundamental philosophical issues underlying the law and politics of atrocity crimes within international criminal justice. Focusing on understanding the experiences of victims and perpetrators, Corrias draws on numerous disciplines to construct his conceptual framework while also using several case studies to examine important issues including references to 'humanity' in the discourse on atrocity crimes; the need for a first-person plural perspective of a 'We' within international criminal justice; the experiences of dehumanization of both victims and perpetrators; the temporalities of suffering and justice; and the tension between individual criminal responsibility and structural violence.

  • In a thought-provoking article, Alec Stone Sweet put forward a problem he called the juridical Coup d'État. His work was the opening of a debate to which Neil Walker, Wojciech Sadurski and Gianluigi Palombella contributed. In a subsequent essay, Stone Sweet responded to their comments. In this article, I would like to sketch this debate and explore its significance for legal theory. It is my hypothesis that the problem of the juridical coup is closely connected with the relationship between constituent (constituting) and constituted (constitutional) power. Moreover, the juridical coup shows in an exemplary way how this relationship should be understood. Before addressing the problem in these terms (Section C), analyzing an additional example of a juridical coup in EU law (Section D) and developing my own position vis-à-vis the different contributors (Section E), in the following section, I will give an overview of the argument of Stone Sweet. Taking into account the wealth of issues raised by him, I will concentrate on those aspects of his essay that are of most interest from a legal-philosophical point of view. Thus, the first question to be answered is: What are we to understand under a Juridical Coup d'État and what is its theoretical importance?

  • The concept of humanity takes up a prominent place in the discourse on international (criminal) law. It remains, however, unclear what exactly is meant by an invocation of humanity. In this article, I aim to contribute to an elucidation of this concept. For this purpose, I will first analyse how the concept of crimes against humanity and the related notions of dehumanization and rehumanization are employed in the case of Duch, the chairman of the infamous Cambodian S-21 prison which functioned under the Khmer Rouge. Second, I will put these findings in a philosophical context. Building on the work of Hannah Arendt, I will devise a conceptual framework to analyse crimes against humanity, dehumanization and rehumanization in order to tease out what is at issue in the concept of humanity in international (criminal) law.

  • The concepts of humanity, human dignity and mankind have emerged in different contexts across international law and biolaw. This raises many different questions. What are the aims for which 'humanity' is mobilised? How do these aims affect the ensuing interpretations of this concept? What are the negative counterparts of humanity, mankind and human dignity? And what happens if a concept developed in one particular context is taken up in another? By bringing together research from international law, biolaw and legal theory, this volume answers such questions by analysing how the concepts overlap and contradict each other across the disciplines. The result is not an examination of what humanity is but rather what it does and what it brings about in a variety of contexts.
