Precarious work, the problems it poses in terms of labour standards/regulation, and remedies to this, have sparked considerable attention from researchers and policy-makers over the past three decades. This paper examines industrial relations (IR) legislation introduced by the Australian Labor government elected in 2022, and which, amongst other things, has addressed precarious work. These initiatives are placed in historical context, noting how essentially similar problems shaped IR regulation a century earlier. The article also examines the more immediate precursors to the legislation, by reviewing state and federal inquiries into precarious work and related issues in Australia from the 1990s onwards. Placing the new legislation into historical context enhances our understanding of the law and surrounding policy debates. The Albanese federal Labor government package of industrial relations laws introduced between 2022 and 2024 marked a paradigm shift from earlier measures. While these reforms are rooted in Australian institutions, law and industrial relations history, they provide an alternative policy template for addressing the problems wrought by neoliberalism on labour standards, especially if accompanied by synergistic reforms in other areas, such as immigration and economic policies promoting manufacturing.

This special Themed Collection of The Economic and Labour Relations Review examines the ‘Economics of Occupational Health and Safety’ (OHS). The economics of OHS looks at how economic structures and incentives, including labour markets and production processes, influence the health and wellbeing of workers and the communities where they live. It is a large and diverse subject that has been viewed from multiple different lenses. This thematic issue can only touch on some of these but will remind readers how economic incentives and industrial competitive pressures affect OHS. This editorial will take the form of an article which explores some of these intersections and places them in a wider context. To do this, the economics of OHS will not only be examined in terms of economic welfare and microeconomics at the industry and workplace level, but also from an historical perspective, as well as the intersection of these levels, thus providing a useful framework to shape research and discussion.

The need to maintain transport during a pandemic places transport workers at higher risk of infection and can have other effects on health and well-being. The aim of this study was to understand the current state of research on the impact of respiratory diseases on transport workers and to identify any existing evidence-based recommendations that can help mitigate the risks associated with these diseases in the transport industry. A scoping review was undertaken as per PRISMA guidelines. A search was conducted in English-language databases for peer-reviewed research articles. We reviewed research articles published over 20 years (2002–2022). We found 12540 articles, of which 39 deemed relevant, were analysed. The review highlighted the high risk of transport workers’ exposure to respiratory diseases during pandemics, exacerbated by structural inequalities including the significant number holding precarious/non-standard jobs. Increased financial strains led to poorer mental health outcomes and risks of detrimental behaviours for health. Economic measures implemented by governments were found to be insufficient in addressing these issues. The review found that transport is a significant transmission point for pandemics of respiratory diseases, and it suggests some remedies to best meet these challenges.

Statesman and scholar Alexis de Tocqueville (1876) once noted, “History is a gallery of pictures in which there are few originals and many copies.” In other words, history has a habit of repeating itself, and we can deduce cycles and patterns that likely will recur. Such stability and inertia should bode well for prediction. Nevertheless, when it comes to election forecasting, especially in the United States, most prognostications rely on short-term political fundamentals measuring macroeconomic performance or government or leader popularity. In this contribution, we adopt a structural approach but depart from existing literature by focusing on historical party and governance dynamics in the vein of de Tocqueville to establish whether they offer solid guidance regarding the performance of Democrats in US congressional elections. Our ex-post political history models provide solid predictions of which party will control Congress and the Democrats’ seat tally in each chamber between 1946 and 2022. This creates conditions to assume that political history may help us forecast Campaign 2024. Our study applied this political history model to predict the 2024 congressional elections. It forecast Democrats to lose control of the Senate with a net loss of three seats and estimated an exceptionally close race for House control, with the point estimate for the House suggesting that the Democrats would fall short of winning control.

In recent decades, there has been a global growth of the use of contract labour in the mining industry, primarily driven by cost/flexibility considerations. At the same time, contracting has been associated with poorer occupational health and safety (OHS) outcomes across a range of industries. Drawing on published research, theses, and government reports, this paper critically reviews the available evidence on the OHS effects of contract labour in mining and the likely implications of further growth in this trend. This evidence confirms that the use of contract labour is associated with worse OHS outcomes, and that the Ten Pathways and Pressure, Disorganisation, and Regulatory failure (PDR) models are both valuable in explaining this. The latter point is confirmed by a more detailed examination of four serious mine incidents in NSW and Queensland. The paper identifies some gaps and areas for further research as well as the actions that mining companies, regulators, and unions could take to improve contractor safety. Notwithstanding the latter, the paper argues that the most effective way of improving contractor safety in mines is reducing the use of contractors overall and concentrating their activities in areas such as major shutdowns/repairs, where contractors have specialised expertise to undertake non-routine tasks. Despite oft-repeated phrases such as zero-harm and management systems, the corporate shift to using contractors is primarily driven by cost-cutting and highlights how OHS is compromised by such priorities.

Deaths in workplace incidents – of both workers and members of the public – normally spark a number of official responses, including coronial inquests. In many instances, however, these investigations have examined the incident in isolation from the wider context of hazards in that industry and are rarely informed by the extensive research literature on health and safety, and death and disaster, at work. In this examination of a tragic theme park disaster in 2016, we demonstrate that applying a wider lens and drawing on the ‘ten pathways model’ not only provides a more compelling explanation of how and why safety measures failed but may also inform more fatality and injury prevention measures. Drawing on James Reasonʼs concept of latent failures, the ten pathways model identifies latent failures that are repeatedly associated with death and disaster in workplaces across different industries. Using the Dreamworld coronial inquest findings and other related source material, this paper finds that at least nine and possibly all ten pattern failures were present in the Thunder River Rapids ride disaster at the Dreamworld theme park and contributed to the deaths of four visitors. In particular, it highlights the corroding effects of poor maintenance, inadequate management systems, and regulatory failure. The paper also raises questions about why theme parks as high-hazard workplaces marked by injuries, deaths, and ‘near misses’ were not subject to more rigorous oversight prior to the event and how regulatory failures might best be addressed.

Since the 1930s, research has indicated that unemployment has serious effects on physical and psychological well-being. Recent evidence confirms these findings and provides greater insight into the processes by which unemployment influences health. It is less widely recognised that job insecurity can also adversely affect the health and well-being of workers. This paper reviews the rapidly growing body of research on the health impact of job insecurity and organisational practices that produce insecurity, such as downsizing and restructuring. Our review identified sixty-eight studies, using a variety of methods and measures, published internationally since 1966. Eighty-eight per cent of these studies indicated that job insecurity was associated with diminished worker health and well-being. Implications of this finding for labour market and industrial relations policies, as well as occupational health and safety, are discussed.

This article has three objectives. First, we examine what is meant by minimum labour standards, including the array of different standards and their procedural and substantive elements, in differing or even diverging regulatory jurisdictions. Examination of different areas of labour standards provides instruction in the dynamics of these protections and we give illustrative examples, from several countries. The second objective is to highlight the importance of enforcement of standards. We do this through a brief historical overview of the emergence of labour standards as well as of how the recent rise of neo-liberalism has shaped current debates over their development and application. The third element of the analysis is an examination of some contemporary debates, pointing to areas requiring further study as well as to positive examples both in research and in policy/regulation.

This discussion paper by a group of scholars across the fields of health, economics and labour relations argues that COVID-19 is an unprecedented humanitarian crisis from which there can be no return to the ‘old normal’. The pandemic’s disastrous worldwide health impacts have been exacerbated by, and have compounded, the unsustainability of economic globalisation based on the neoliberal dismantling of state capabilities in favour of markets. Flow-on economic impacts have simultaneously created major supply and demand disruptions, and highlighted the growing within-country inequalities and precarity generated by neoliberal regimes of labour market regulation. Taking an Australian and international perspective, we examine these economic and labour market impacts, paying particular attention to differential impacts on First Nations people, developing countries, women, immigrants and young people. Evaluating policy responses in a political climate of national and international leadership very different from those in which major twentieth century crises were addressed, we argue the need for a national and international conversation to develop a new pathway out of crisis.

Every year, there are over 200 traumatic deaths at work in Australia. A government safety inspector usually investigates each incident. The investigation may lead to prosecution of the employer or another party deemed to have breached relevant legislation. However, little systematic research has examined the needs and interests of grieving families in this process. Drawing on interviews with 48 representatives of institutions that deal with deaths at work (including regulators, unions, employers, police and coronial officers), this article examines how they view the problems and experiences of families. Notwithstanding some recent improvements, findings indicate ongoing shortcomings in meeting the needs of families regarding information provision, involvement and securing justice.

The activism of coalmining unions in Australia, the UK, the USA and elsewhere securing improvements in safety including better legislation in the 19th and 20th centuries, has been widely researched and acknowledged. However, a relatively neglected aspect of this history was a campaign to secure worker inspectors (check-inspectors). These began in coalmining a century before similar measures were introduced for workers more generally as part of overhauling occupational health and safety laws in the 1970s/1980s. We document this struggle for mine safety in Australia and New Zealand, and the activities of check-inspectors in the period to 1925. Notwithstanding strong opposition from coal-owners and conservative governments, check-inspectors played an important role in safeguarding coalminers and improving the regulatory oversight of coalmines. Check-inspectors not only gave coalminers a ‘voice’ in OHS, but they also provided an exemplar of the value and legitimacy of worker’s ‘knowledge activism’. This system remains. Furthermore, the struggle is relevant to understanding contemporary debates about collective worker involvement in occupational health and safety.

Human civilisation faces a series of existential threats from the combination of five global and human-engineered challenges, namely climate change, resource depletion, environmental degradation, overpopulation and rising social inequality. These challenges are arguably being manifested in both an increased likelihood and magnified impact of catastrophes like forest fires, prolonged droughts, pandemics and social dislocation/upheaval. This article argues that in understanding and addressing these challenges, important lessons can be drawn from what has repeatedly caused organisational failures. It applies the ‘Ten Pathways to Disaster’ model to a series of disasters/catastrophic events and then argues this model is salient to understanding inadequate responses to the five threats to civilisation. The article argues that because these challenges interact in mutually reinforcing ways, it is critical to address them simultaneously not in isolation.

over the past 20 years the labour markets of most industrialised countries have undergone a series of profound changes. These changes have been associated with significant changes in work processes, employment conditions, union density and industrial relations. This paper provides an overview of the labour market restructuring occurring in most industrialised societies. In addition to the growth in temporary, part-time work and self-employment, changes in the extent of agency labour, homework, telework, outsourcing, franchising and the timing of work are also considered. A series of complex interconnections are identified. It is argued that in many cases, the socio-economic consequences of these changes have been compounded by alterations to policies and laws dealing with industrial relations, labour markets, competitive tendering, privatisation and social security.
