Principles of Tort Law

Principles of Tort Law

Welcome to the resources site

Here you will find free-of-charge online materials to accompany this book. The range of materials we provide across our academic and higher education titles are an integral part of the book package, whether you are a student, instructor, researcher, legal practitioner, a policy maker or law reformer, or a member of the judiciary.

The online chapters which form part of this book deal with torts, or issues arising from Tort Law, which do not feature as commonly in Torts curricula as those materials which are contained in the print book, but which nevertheless may arise for student consideration from time to time.  Hence, the online chapters incorporate the study of particular manifestations of negligence, such as the statutory regimes enacted for defective products and for damage caused by animals, and also consider wider torts such as Public Nuisance, Privacy, or the statutory tort of Harassment. Additionally, the often tricky concepts associated with multiple defendants in torts, and the issues to do with when a tortious cause of action 'accrues', limitation periods, and when a defendant's liability in tort ends, are also dealt with in the online chapters.  The online content may also assist students who are studying aspects of Tort as part of other law modules (such as Media Law, Public Authorities and the Law, or Medical Negligence Law), or who are studying such issues for the purposes of mooting, writing research essays, legal advice clinic work, and the like.

Occasionally, a section of a print chapter is excised from that chapter and is available online. For example, some of the categories of defendants for whom a duty of care has been a legal issue (e.g., barristers, parental liability for their children's negligence, parental liability to their children, and the liability of regulators, inspectors and certifiers) are contained in Chapter 2 as online content only.

An explanation of the principle numbering used in the online content

Each online chapter has an acronym as a unique identifier.  The principles in the online chapters adopt their numbering from that acronym, so that, just as with the principles in the print book, each principle has a unique identifier.

For example, principle 12 in each of the online chapters is designated as follows: §DP.12, for the 'Defective Products' chapter; §AN.12, for the 'Liability for Animals' chapter; §EM.12, for the 'Employers’ Liability' chapter; §SD.12, for the 'Breach of Statutory Duty' chapter; §HA.12, for the 'Statutory Tort of Harassment' chapter; §WD.12, for 'The Rule in Wilkinson v Downton' chapter; §PR.12, for the 'Privacy' chapter; §PU.12, for the 'Public Nuisance' chapter; §MD.12, for the 'Multiple Defendants' chapter; and §BE.12, for the 'Beginning and End of Liability' chapter.

Where, within a print chapter, a small section of the chapter is available online, the principles in that online-only section uses a separate referencing system, whereby the principle adopts the chapter number, but uses an alphabetical identifier.  For example, as noted above, Chapter 2 is a print chapter, but contains some small sections of online content.  For the first online section in that chapter concerning 'Barristers', the principle in that section is numbered as §2.A.  The next online section in that chapter concerns ‘Parental liability for their children’s negligence’, in which the relevant principles are numbered as §2.B and §2.C. The next online principle in Chapter 2 is under the section, ‘Parental liability to their children’, and is numbered as §2.D.

Hence, each principle in the book, whether contained in the print chapters or the online chapters, has a unique identifier which directs the reader to its precise location.
