Dignity and Rank

Abstract

This paper considers the meaning conveyed by the term “dignity” in human rights discourse. It considers various ambiguities associated with the term (e.g. Does it describe the content or the ground of certain rights?) as well as alternative accounts of the kind of meaning that “dignity” has (descriptive or evaluative, technical or ordinary language). The second part of the paper argues that the distinctive contribution that “dignity” makes to human rights discourse is associated, paradoxically, with the idea of rank: once associated with hierarchical differentiations of rank and status, “dignity” now conveys the idea that all human persons belong to the same rank and that, that rank is a very high one indeed, in many ways as high as what were formerly regarded as ranks of nobility.

L'article part des ambiguïtés du mot « dignité » dans le discours sur les droits de l'homme. S'agit-il du contenu de certains droits ou de leur fondement? L'auteur argumente que la contribution spécifique de la « dignité » est, paradoxalement liée à la notion hiérarchique de « rang » et véhiculerait donc l'idée que tous les humains sont au même rang et que celui-ci est élevé, virtuellement comparable à ce qu'étaient ceux de la noblesse.

In der Menschenrechtsdebatte ist die Definition des Wortes Würde zweideutig. Handelt es sich um den Inhalt gewisser Rechte oder um deren Grundlage? Der Autor behauptet, dass der Begriff der Würde sich mit dem des Rangs verbindet. Früher ein Mittel um Rang und Status zu verdeutlichen, wird Würde nun als Zeichen verstanden, dass alle Menschen dem gleichen Rang angehören, der sehr hoch anzusetzen ist, vergleichbar dem des Adels.
