Summary
This chapter continues the analysis of ‘works’ that are not protected by copyright. While Chapter 7 deals with works that fail to satisfy the minimum requirements for protection, this chapter deals with works that form part of public domains as they are excluded from copyright protection under national laws. The chapter engages in comparative analysis of: works (such as ‘news of the day’) that are expressly excluded from protection; works that are excluded (or otherwise limited) by national constitutional law; and works that are excluded (or otherwise limited) on the grounds of public policy or public interest considerations. For each category of excluded works, the chapter explains the implications for national public domains.
