One widely used method for allocating health care resources involves the use of cost-effectiveness analysis (CEA) to rank treatments in terms of quality-adjusted life-years (QALYs) gained. CEA has been criticized for discriminating against people with disabilities by valuing their lives less than those of non-disabled people. Avoiding discrimination seems to lead to the 'QALY trap': we cannot value saving lives equally and still value raising quality of life. This paper reviews existing responses to the QALY trap and argues that all are problematic. Instead, we argue that adopting a moderate form of prioritarianism avoids the QALY trap and disability discrimination.

Following Locke, philosophical discussion of private property has tended to focus on the acquisition of natural resources as central. In this paper I first pursue the idea that the resource paradigm doesn't apply to most developed economies, and show how this creates problems for many accounts of property. My second ambition is to draw a normative conclusion by showing that redistribution of wealth generated in the context of services is more difficult to justify compared with the natural resource paradigm philosophers have often focused on.

I argue that the use of a social discount rate to assess the consequences of climate policy is unhelpful and misleading. I consider two lines of justification for discounting: (i) ethical arguments for a ‘pure rate of time preference’ and (ii) economic arguments that take time as a proxy for economic growth and the diminishing marginal utility of consumption. In both cases I conclude that, given the long time horizons, distinctive uncertainties, and particular costs and benefits at stake in the climate context, discount rates are at best a poor proxy for the normative considerations they are meant to represent.

If group members aim to fulfil a collective obligation, they must act in such a way that the composition of their individual actions amounts to a group action that fulfils the collective obligation. We study a strong sense of joint action in which the members of a group design and then publicly adopt a group plan that coordinates the individual actions of the group members. We characterize the conditions under which a group plan successfully coordinates the group members’ individual actions, and study how the public adoption of a plan changes the context in which individual agents make a decision about what to do.

A common justification offered for unequal pay is that it encourages socially beneficial productivity. G. A. Cohen famously criticizes this argument for not questioning the behaviour and attitudes that make those incentives necessary. I defend the communal status of incentives against Cohen's challenge. I argue that Cohen's criticism fails to appreciate two different contexts in which we might grant incentives. We might grant unequal payment to someone because they demand it. However, unequal payment might be an offer instead. I claim that incentives as offers promote the ideal of society as a cooperative venture for mutual advantage.

Freedom is often analysed in terms of the absence of intentionally imposed constraints. I defend the alternative view on which the relevant constraints are those for which some agent can be held morally responsible. I argue that this best captures the relation between freedom and respect. Berlin (1969) correctly points out that intentional restrictions exhibit ill will and hence are disrespectful. However, the same holds, I argue, for restrictions that are due to indifference. Berlin also observed that it would be counterintuitive if an agent could increase her freedom by changing her preferences. I criticize the argument that Dowding and Van Hees (2007, 2008) present according to which this observation counts in favour of explicating freedom in terms of intentionality.

This article surveys the debate over the social discount rate. The focus is on the economics rather than the philosophy literature, but the survey emphasizes foundations in ethical theory rather than highly technical details. I begin by locating the standard approach to discounting within the overall landscape of ethical theory. The article then covers the Ramsey equation and its relationship to observed interest rates, arguments for and against a positive rate of pure time preference, the consumption elasticity of utility, and the effect of various sorts of uncertainty on the discount rate. Climate change is discussed as an application.

According to the priority view, or prioritarianism, it matters more to benefit people the worse off they are. But how exactly should the priority view be defined? This article argues for a highly general characterization which essentially involves risk, but makes no use of evaluative measurements or the expected utility axioms. A representation theorem is provided, and when further assumptions are added, common accounts of the priority view are recovered. A defence of the key idea behind the priority view, the priority principle, is provided. But it is argued that the priority view fails on both ethical and conceptual grounds.

Most game-theoretic accounts of institutions reduce institutions to behavioural patterns the players are incentivized to implement. An alternative account linking institutions to rule-following behaviour in a game-theoretic framework is developed on the basis of David Lewis’s and Ludwig Wittgenstein's respective accounts of conventions and language games. Institutions are formalized as epistemic games where the players share some forms of practical reasoning. An institution is a rule-governed game satisfying three conditions: common understanding, minimal awareness and minimal practical rationality. Common understanding has a strong similarity with Ludwig Wittgenstein's concept of lebensform while minimal awareness and minimal practical rationality capture the idea that rule-following is community-based.

The value of health states is often understood to depend on their impact on the goodness of people's lives. As such, prominent health states metrics are grounded in particular conceptions of wellbeing – e.g. hedonism or preference satisfaction. In this paper, I consider how liberals committed to the public justification requirement – the requirement that public officials choose laws and policies that are justifiable to their citizens – should evaluate health states. Since the public justification requirement prohibits public officials from appealing to controversial conceptions of the good life, liberals committed to this principle face a significant puzzle.

This paper discusses the definition of the state space and corresponding choice sets that figure in the theory of decision making under uncertainty. It elucidates an approach that overcomes some conceptual difficulties with the standard models and accommodates a procedure for expanding the state space in the wake of growing awareness.

Several areas of welfare economics seek to evaluate states of affairs as a function of interpersonally comparable individual utilities. The aim is to map each state of affairs onto a vector of individual utilities, and then to produce an ordering of these vectors that can be represented by a mathematical function assigning a real number to each. When this approach is used in intertemporal contexts, a central theoretical question concerns the rate of pure time preference, i.e. the evaluative weight to be applied to utility coming at different times. This article criticizes the standard philosophical account of pure time preference, arguing that it ascribes to economists a methodological commitment they need not accept. The article then evaluates three further objections to pure time preference, concluding that it might still be defensible under certain circumstances. I close by articulating a final argument that, if sound, would constitute a decisive objection to pure time preference as it currently figures in much intertemporal welfare economics.

According to Wlodek Rabinowicz's (2008) fitting-attitude analysis of value relations, two items are on a par if and only if it is both permissible to strictly prefer one to the other and permissible to have the opposite strict preference. Rabinowicz's account is subject, however, to one important objection: if strict preferences involve betterness judgements, then his analysis contrasts with the intuitive understanding of parity. In this paper, I examine Rabinowicz's three responses to this objection and argue that they do not succeed. I then propose an alternative solution. I argue that the objection can be avoided if we ‘relativize’ Rabinowicz's account and define parity in terms of opposite strict preferences between two items that are only relatively permissible, rather than permissible simpliciter. I argue that this account of parity can be defended if we take seriously the distinction between sufficient and decisive reason for a preference relation. I also show that, on the basis of this distinction, we can arrive at a more extensive taxonomy of value relations than the one proposed by Rabinowicz.

This paper develops a novel competition criterion for evaluating institutional schemes. Roughly, this criterion says that one institutional scheme is normatively superior to another to the extent that the former engenders more widespread political competition than the latter. I show that this criterion should be endorsed by both global egalitarians and their statist rivals, as it follows from their common commitment to the moral equality of all persons. I illustrate the normative import of the competition criterion by exploring its potential implications for the scope of egalitarian principles of distributive justice. In particular, I highlight the challenges it raises for global egalitarians’ efforts to justify extending the scope of egalitarian justice beyond the state.

Most people at some point in their lives face transformative decisions that could result in experiences that are radically different from any that they have had, and that could radically change their personalities and preferences. For instance, most people make the conscious decision to either become or not become parents. In a recent but already influential book, L. A. Paul (2014) argues that transformative choices cannot be rational – or, more precisely, that they cannot be rational if one assumes what Paul sees as a cultural paradigm for rational decision-making. Paul arrives at this surprising conclusion due to her understanding of transformative experience as being both epistemically and personally transformative. An experience is epistemically transformative if it ‘teaches [a person] something she could not have learned without having that kind of experience’ (11), but it is personally transformative if it changes the person's point of view and her fundamental preferences (16).
