This article examines how well imported institutional models fare in their recipient sites, how far they are modified by the conditions they encounter, and which variables determine the outcomes. The analysed set of variables consists of particular actors and agencies involved in the transplant project; the strategy they choose for its implementation; and the local in terms of those who might support it and those who might oppose it. The arguments of the article are based on the findings of research carried out on social engineering projects undertaken in Russia and Bosnia. The projects consisted of the establishment of new bodies closely modelled on the UK Press Complaints Commission.

Throughout the history of the modern state, homosexuality has been a legal category, and not simply a medical or a psychiatric one. Fear of that legal subject manifests itself in law and policy not only about ‘the family’ but also about nationhood and citizenship. This is an article about this fear of the ‘Wandering Gay’, about the ways in which this fear has influenced domestic and international law regarding recognition in same-sex relationships, and about ways in which it can be overcome. I begin by introducing the Wandering Gay as a hidden driving cultural concept behind a state's reluctance (and in some places, outright objection) to recognise same-sex relationships. I then compare American and Israeli immigration policies concerning immigrants' sexuality, and discuss the different focuses of each system: while American policy (prior to its reform) was mainly concerned with ‘sexual deviancy’, Israeli policy was concerned with otherness, particularly non-Jewishness, in general. However, as I argue, homosexuality is one way in which individuals are ‘othered’ by Israeli immigration policy, since they cannot acquire legal status based on their marital status. I then contend that marriage is being used as a weapon against LGBT individuals, and that this is done from within a discourse that elevates marriage to a right that only heterosexual citizens are entitled to. I argue that marriage is used as a means of discrimination against minorities, and I question whether the proper solution to this violation of human rights is indeed to add more and more minorities to the privileged class of those who can marry, thus equipping them with the weapon of marriage to use against others.

This issue of the journal includes the first article to be published in an exciting new section entitled ‘Law in other contexts’. This section is dedicated to making available specially commissioned reports of socio-legal research in places where English is not the first language. In this way the journal hopes to bring attention to work which may not be easily accessible to those without knowledge of the relevant language (and culture). It is also hoped that this may – eventually – make some contribution to putting into question the Anglo- American hegemony over how this academic field is constituted, which questions are considered important to ask, and which methods are thought appropriate for studying them. Articles will be included regularly in issues of the journal as they become available. Potential authors from a variety of jurisdictions have already been contacted (and others will be contacted in the future).

This article analyses the way in which the use of the rights to family life and to private life has evolved as a bar to the deportation of immigrants. The analysis focuses on the jurisprudence of the European Court of Human Rights (ECtHR) with respect to the European Convention on Human Rights and Fundamental Freedoms, which uses a rights-based framework; and of the UN Human Rights Committee (HRC) with respect to the International Covenant on Civil and Political Rights, which uses a status-based framework. It notes the interaction between the two bodies and the attempt in each forum to modify its normative framework to follow the other's. The article further considers the implications of each normative framework for both integrated immigrants and other immigrants.

This article presents a selective survey of current law and society research in the Netherlands. After a brief historical sketch, it focuses on contemporary Dutch studies on legal effectiveness and several studies on courts and dispute resolution. Based on a review of both fields, I identify two important trends in Dutch law and society research. The first trend is that, since the 1970s, most researchers have been interested in ‘old gap studies’, which primarily focus on the efficacy of law. In recent years, however, public opinion in the Netherlands has become increasingly critical of the Dutch justice system. I argue that this has generated a second trend in Dutch law and society research, which I refer to as ‘new gap studies’. Unlike traditional gap studies, their primary focus is not the efficacy but the legitimacy of law. In the final section, I draw several general conclusions and I look forward to the future of law and society research in de Netherlands.

For scholars of law, the turn to Michel Foucault's works almost inevitably invokes an apology, a qualification, or a caveat. With the acknowledgement that Foucault never offers a sustained account of law as an ‘object of inquiry’ comes a sense that his work might nonetheless offer important insight into contemporary forms of law and modern legal problems. The difficulty with which many scholars struggle is how to begin from the position of this ‘nevertheless’ or ‘however’ that marks the contingent ground from which they argue. That is, scholars grapple with how to make Foucault say something about law when what he says is indirect or culled from several different works.

The Idea of Justice is one of those books that – whether we agree with its ultimate conclusions or not – will be virtually impossible to ignore. And for good reason: it takes on one of the great political philosophers of our time, John Rawls, and deepens, enriches and challenges some basic Rawlsian ideas. Sen's basic argument is that the Rawlsian approach to justice, which has profoundly influenced the development of contemporary political theory since the publication of A Theory of Justice in 1971, is so focused on ideal, transcendentally just institutions that it is unable to offer practical guidance for advancing justice in an increasingly borderless world. Sen's ambitious critique of Rawls takes him on a winding but engaging path, through political and moral philosophy, economics, history and law. Along the way, he challenges mainstream economic theories of rationality, explores deontological and consequentialist ethics through the lens of classical Indian thought, articulates and defends an understanding of freedom in terms of capability, and rethinks the relationship between development, agency and democracy in a global context.
