Le droit canadien du divorce a été jusqu'à présent profondement influencé par le droit anglais. En effet, en vertu de l'article 91 (26) de l'Acte de l'Amérique du Nord britannique, le Parlement canadien, à l'exclusion des parlements des provinces, a le pouvoir de légiférer en matière de divorce. Jusqu'à l'adoption de la Loi fédérale sur le divorce en 1968, il avait rarement exercé ce droit et toujours sur des points de détails. Chaque province avait donc conservé le droit anglais qui la régissait au moment de son entrée dans la Confédération. Il s'agissait en général de la loi anglaise de 1857. Deux provinces, le Québec et Terre-Neuve, ignoraient le divorce et leurs habitants ne pouvaient divorcer que par une décision spéciale du Parlement canadien, qui a été remplacee, en 1963, par une décision du seul Sénat.

A marriage may be dissolved either by a court decision or, under certain conditions, by the decision of the administrative authorities. The administrative method may only be used if the parties agree to obtain a divorce and to certain of the conditions for the divorce, such as the custody and maintenance of the children.

The case of Le Mesurier v Le Mesurier at the end of the last century firmly established the principle that, in England, the jurisdiction of the court in divorce matters is based solely on the domicile of the parties at the date of institution of the proceedings (1, 7). It was strongly felt that there should be unity of domicile of husband and wife and thus, in effect, the domicile of the parties was that of the husband, the wife retaining, so long as the marriage subsisted, the domicile of her husband (3).

On distingue en droit international privé français en matière de divorce comme en toute autre matière deux sortes de compétence: une compétence fondée sur la nationalité française de l'une des parties et une compétence de droit commun. En vertu des articles 14 & 15 du Code Civil les tribunaux français sont compétents chaque fois qu'un Français est demandeur (art. 14) ou défendeur (art. 15). Il s'agit là d'une compétence dite générale ou internationale des tribunaux français. Il faut ensuite désigner le tribunal spécialement compétent. Cette désignation a lieu sans difficulté quand on peut appliquer la règie interne de compétence territoriale qui désigne le tribunal du domicile du défendeur (art. 59 c. pr. civ.). Comme aux termes de l'article 108 du code civil, la femme est domiciliée de droit chez son mari, il s'agit en fait du tribunal du domicile du mari. C'est pourquoi de nombreux arrêts emploient la formule de domicile conjugal. Si un tel domicile n'existe pas en France, le demanduer “peut porter le litige devant le tribunal de son domicile ou de sa résidence ou encore devant un tribunal que des circonstances speciales font apparaître comme particulièrement désigné pour une bonne administration de la justice”

Dans cet exposé seront traités brièvement: la compétence internationale des tribunaux helléniques; la procédure du divorce; le droit applicable au fond; et la reconnaissance des jugements étrangers de divorce.

In Israel, jurisdiction in suits for divorce, in common with other matters of personal status, is exercised by the courts of the various religious communities, forming separate hierarchies independent of the ordinary civil courts. This principle was first laid down by the Palestine Order in Council, 1922, 1 Article 51.

L'annulation du mariage et la reconnaissance des decisions etrangeres d'annulation étaient les seuls moyens de dissolution du lien conjugal en Italie avant la Loi du ler décembre 1970, n. 898. II est donc évident que les decisions italiennesen la matière ont été toujours nombreuses et susceptibles de poser des problèmes complexes de droit international priv´ (conflits de juridiction, conflits de lois et reconnaissance de décisions étrangères).

Formerly, jurisdiction in divorce cases was regulated by ss. 262 and 266 of the Civil Code. These provisions have been left out of the new Book 1 of the Civil Code, which came into force on January 1, 1970. Jurisdiction is now being dealt with by the new s. 814 of the Code of Civil Procedure, of which the text (as adapted by the Divorce Reform Act 1971, S. 290, in force October 1,1971) runs as follows:

In matters of divorce, judicial separation, and dissolution of marriage after judicial separation, the Dutch courts have jurisdiction if, at the commencement of the action:

a. both parties are Dutch nationals; or

b. one of the parties, if both parties are petitioning together, for the previous six months has had his domicile in the Netherlands; or

c. the respondent has had for the previous six months, or the petitioner for the previous twelve months—or if he is a Dutch national for the previous six months—his domicile in the Netherlands.

The competent court is the district court of the domicile of either party, if they are petitioning together and otherwise the district court of the domicile of the respondent or, if only the petitioner is domiciled in the Netherlands, the district court of that domicile. If neither of the parties is domiciled in the Netherlands, the District Court of The Hague is the competent court (etc.).

La LRDC distingue, pour ce qui est de la compétence du juge suisse de divorce, selon qu'il s'agit d'un demandeur suisse domicilié à l'étranger ou d'un demandeur étranger domicilié en Suisse.

According to Swedish law separation and divorce decrees may only be granted by the courts. If both spouses are agreed that they cannot continue the matrimonial cohabitation they can always demand a separation. Furthermore each spouse may obtain a separation if the other has grossly violated his matrimonial duties or if the marriage has broken down due to deep and lasting disagreements. When a legal separation has lasted for one year each spouse may demand a divorce, and this is the ground for divorce most widely relied upon in Sweden. There are, however, several other grounds for divorce among which the most important are adultery and living apart for a period of at least three years.
