Summary
I come neither to celebrate nor to disparage Hohfeld, but to parley with him. Perhaps it is worth exploring why the former courses are said to be on the table, depending upon one’s preferred strand of property theory. After all, Hohfeld’s project is presented as purely analytical. He does not purport to tell us what the substantive contents of the law should be, but merely to provide tools that permit unambiguous analytical description of a given positive landscape. There is no reason why a project thus conceived should necessarily be in tension with any particular substantive theory of property law.

Summary
Accounts of property tend to define it as a right to exclude and treat use-privileges as incidental by-products of that right. In contrast, this paper treats recognition of use-privileges as prior and then asks what sorts of rights might be justified in their support. I defend this approach against arguments made by Douglas & Ben McFarlane. As the concept of “use” depends upon that of “thing,” I also attempt to shore up the reliance on “things” as central to the concept of property, arguing for a concept of “thing” that encompasses any discrete and intelligible nexus of human activity with respect to which human purposes may come into conflict; this renders intellectual property rights straightforwardly intelligible as usufructary interests in things. I also respond to Essert’s argument that property should jettison any reliance on things and simply view property rights as aimed at excluding others from classes of activity. Here my contention is that the identification of some discrete “thing” as an object of property provides a necessary focal point for the concepts of use and interest that are both functionally and normatively essential to property as a human institution.
The UCLA study of Predictors of Cognitive Functioning Following Moderate/Severe Pediatric Traumatic Brain Injury

Objectives: Following pediatric moderate-to-severe traumatic brain injury (msTBI), few predictors have been identified that can reliably identify which individuals are at risk for long-term cognitive difficulties. This study sought to determine the relative contribution of detailed descriptors of injury severity as well as demographic and psychosocial factors to long-term cognitive outcomes after pediatric msTBI. Methods: Participants included 8- to 19-year-olds, 46 with msTBI and 53 uninjured healthy controls (HC). Assessments were conducted in the post-acute and chronic stages of recovery. Medical record review provided details regarding acute injury severity. Parents also completed a measure of premorbid functioning and behavioral problems. The outcome of interest was four neurocognitive measures sensitive to msTBI combined to create an index of cognitive performance. Results: Results indicated that none of the detailed descriptors of acute injury severity predicted cognitive performance. Only the occurrence of injury, parental education, and premorbid academic competence predicted post-acute cognitive functioning. Long-term cognitive outcomes were best predicted by post-acute cognitive functioning. Discussion: The findings suggest that premorbid factors influence cognitive outcomes nearly as much as the occurrence of a msTBI. Furthermore, of youth with msTBI who initially recover to a level of moderate disability or better, a brief cognitive battery administered within several months after injury can best predict which individuals will experience poor long-term cognitive outcomes and require additional services.
