The focal concerns of jurors evaluating mitigation: Evidence from federal capital jury forms

Mitigating evidence in capital trials provides reasons for a life, rather than death, sentence. Research suggests that mitigation challenges jurors. We contribute to this area by analyzing federal verdict forms in capital cases, which allow jurors to write in their own mitigating factors, providing a direct, rare window onto their mitigation considerations. We use 205 forms from 171 juries to examine the frequency and content of these “write-ins,” using a sentencing theory typically applied to judges, Focal Concerns Theory. We find that four of every 10 juries prompted to offer their own mitigation do so, producing 149 unique write-ins, the majority of which introduces mitigation topics that differ from those listed on the verdict form. Surprisingly, jurors are less likely to offer write-in mitigators in cases involving White defendants than others, even after controlling for support for other mitigating factors and for aggravating factors, which also predict write-ins. Jurors' write-ins reflect a traditional sentencing concern for blameworthiness, and consistent with Focal Concerns Theory, attention to the practical consequences of punishment. Jurors also offered concerns we term “procedural fairness.” Results indicate that juries' views are patterned in ways that are similar, but not identical, to judges' sentencing concerns.

Summary
The first primate-like mammals to appear in the fossil record date to the earliest Palaeocene (Clemens, 2004; Fox and Scott, 2011; Silcox and López-Torres, 2017; Van Valen and Sloan, 1965), and the first primates of modern aspect (euprimates) do not appear until the latest Palaeocene/earliest Eocene (Morse et al., 2019; Ni et al., 2013; Rose et al., 2012; Sigé et al., 1990; Silcox et al., 2017; Smith et al., 2006). However, the most recent molecular estimates for the last common ancestor (LCA) of all living primates suggest that the order originated at some point between the late Cretaceous and the early Palaeocene (approximately between 60 and 70 Mya; Andrews et al., 2016; Herrera and Dávalos, 2016; Seiffert et al., 2018). Later, between 42 and 55 Mya (according to the same sources for molecular dates), Strepsirrhini split into the progenitors of the infraorders Lemuriformes and Lorisiformes (throughout this chapter we use the taxonomy established by Grubb et al., 2003). The Lemuriformes went on to radiate into the vast array of morphologically diverse living and extinct lemurs located on the island of Madagascar, and the lorisiforms split into two families: Lorisidae (pottos, angwantibos, slender lorises and slow lorises) and Galagidae, the bushbabies (Covert, 2002; Martin, 1990; Rasmussen and Nekaris, 1998).

The final effort of the CLIMAP project was a study of the last interglaciation, a time of minimum ice volume some 122,000 yr ago coincident with the Substage 5e oxygen isotopic minimum. Based on detailed oxygen isotope analyses and biotic census counts in 52 cores across the world ocean, last interglacial sea-surface temperatures (SST) were compared with those today. There are small SST departures in the mid-latitude North Atlantic (warmer) and the Gulf of Mexico (cooler). The eastern boundary currents of the South Atlantic and Pacific oceans are marked by large SST anomalies in individual cores, but their interpretations are precluded by no-analog problems and by discordancies among estimates from different biotic groups. In general, the last interglacial ocean was not significantly different from the modern ocean. The relative sequencing of ice decay versus oceanic warming on the Stage 6/5 oxygen isotopic transition and of ice growth versus oceanic cooling on the Stage 5e/5d transition was also studied. In most of the Southern Hemisphere, the oceanic response marked by the biotic census counts preceded (led) the global ice-volume response marked by the oxygen-isotope signal by several thousand years. The reverse pattern is evident in the North Atlantic Ocean and the Gulf of Mexico, where the oceanic response lagged that of global ice volume by several thousand years. As a result, the very warm temperatures associated with the last interglaciation were regionally diachronous by several thousand years. These regional lead-lag relationships agree with those observed on other transitions and in long-term phase relationships; they cannot be explained simply as artifacts of bioturbational translations of the original signals.

Although compulsory, many people treat jury duty as voluntary. This article examines the conceptual and empirical links between participating in voluntary activity and stated willingness to serve on a jury. We also consider the role of engaging in other normative behaviors. Analysis of 1,304 US citizens in the Survey of Texas Adults showed an initial relationship between volunteering and willingness to serve, net of personal resources, prior jury service, and prosocial attitudes. However, indicators of normative activities (voting, contacting elected officials, keeping up with medical appointments, and avoiding bars) largely eliminated this relationship. People who volunteered some, but not too much, were more willing; an analysis of domains of volunteering showed that engaging in public service work predicted willingness. Results suggest that the public service and duty‐based nature of jury participation should be emphasized to understand willingness to serve and to consider novel ways to increase summons responses.

The judge in a jury trial is charged with excusing prospective jurors who will not be impartial. To assess impartiality, prospective jurors are typically asked whether they can be fair. Using an experimental paradigm, we found that small changes in jurors' self-reported confidence in their ability to be fair affected judges' decisions about bias but did not affect the judgments of either attorneys or jurors. We suggest why a judge's role and unique relationship with jurors is likely to foster a decision strategy based on reported juror confidence, and we discuss the implications of our analysis for current legal debates over jury selection practices. Unexpected patterns in our results also highlight the ways in which perceptions of impartiality are affected, in part, by the social characteristics of the observer.

Background
Clinical guidelines recommend the routine use of a single antipsychotic drug in a standard dose, but prescriptions for high-dose and combined antipsychotics are common in clinical practice.
AimsTo evaluate the effectiveness of a quality improvement programme in reducing the prevalence of high-dose and combined antipsychotic prescribing in acute adult in-patient wards in the UK.
MethodBaseline audit was followed by feedback of benchmarked data and delivery of a range of bespoke change interventions, and then by a further audit 1 year later.
ResultsThirty-two services participated, submitting data for 3942 patients at baseline and 3271 patients at the 1-year audit. There was little change in the prevalence of high-dose (baseline 36%; re-audit 34%) or combined antipsychotic prescribing (baseline 43%; re-audit 39%). As required (‘p.r.n.’) prescriptions were the principal cause of both high-dose and combined antipsychotic prescribing on both occasions.
ConclusionsThe quality improvement programme did not have a demonstrable impact on prescribing practice in the majority of services. Future efforts to align practice with clinical guidelines need to specifically target the culture and practice of p.r.n. prescribing.

Jury service in the United States is both compulsory and yet distributed to some but not others in a nonsystematic way. Concerns about unfairness in this distribution system have led to legal changes; however, there is still little empirical information on how jurors view the jury selection process. This study considers jury selection in terms of participants' perceptions of procedural and distributive justice. I argue that justice in this setting is related to areas of conflict between the decision maker and the prospective jurors, especially over privacy protection, despite strong rhetoric that jurors minimize their own preferences and rights in this setting. Data from interviews of 194 formerly excused and selected jurors support this contention.
