From Genetics to Genomics: Facing the Liability Implications in Clinical Care

Health care is transitioning from genetics to genomics, in which single-gene testing for diagnosis is being replaced by multi-gene panels, genome-wide sequencing, and other multi-genic tests for disease diagnosis, prediction, prognosis, and treatment. This health care transition is spurring a new set of increased or novel liability risks for health care providers and test laboratories. This article describes this transition in both medical care and liability, and addresses 11 areas of potential increased or novel liability risk, offering recommendations to both health care and legal actors to address and manage those liability risks.
Determination of Death by Neurologic Criteria in the United States: The Case for Revising the Uniform Determination of Death Act

Although death by neurologic criteria (brain death) is legally recognized throughout the United States, state laws and clinical practice vary concerning three key issues: (1) the medical standards used to determine death by neurologic criteria, (2) management of family objections before determination of death by neurologic criteria, and (3) management of religious objections to declaration of death by neurologic criteria. The American Academy of Neurology and other medical stakeholder organizations involved in the determination of death by neurologic criteria have undertaken concerted action to address variation in clinical practice in order to ensure the integrity of brain death determination. To complement this effort, state policymakers must revise legislation on the use of neurologic criteria to declare death. We review the legal history and current laws regarding neurologic criteria to declare death and offer proposed revisions to the Uniform Determination of Death Act (UDDA) and the rationale for these recommendations.

Objective: Idiopathic normal pressure hydrocephalus (INPH) is a neurological disorder presenting with gait, cognitive, and bladder symptoms in the context of ventricular enlargement. Although gait is the primary indicator for treatment candidacy and outcome, additional monitoring tools are needed. Line Tracing Test (LTT) and Serial Dotting Test (SDT), two psychomotor tasks, have been introduced as potential outcome measures but have not been widely studied. This preliminary study examined whether LTT and SDT are sensitive to motor dysfunction in INPH and determined if accuracy and time are important aspects of performance. Methods: Eighty-four INPH subjects and 36 healthy older adults were administered LTT and SDT. Novel error scoring procedures were developed to make scoring practical and efficient; interclass correlation showed good reliability of scoring procedures for both tasks (0.997; p<.001). Results: The INPH group demonstrated slower performance on SDT (p<.001) and made a greater number of errors on both tasks (p<.001). Combined Time/Error scores revealed poorer performance in the INPH group for original-LTT (p<.001), modified-LTT (p≤.001) and SDT (p<.001). Conclusions: These findings indicate LTT and SDT may prove useful for monitoring psychomotor skills in INPH. While completion time reflects impaired processing speed, reduced accuracy may suggest planning and self-monitoring difficulties, aspects of executive functioning known to be compromised in INPH. This is the first study to underscore the importance of performance accuracy in INPH and introduce practical/reliable error scoring for these tasks. Future work will establish reliability and validity of these measures and determine their utility as outcome tools. (JINS, 2016, 22, 341–349)

Use of Home Care Services among the Elderly in Eastern Canada*

Objective: To compare demographic and functional characteristics of elderly users and non-users of home care services in urban Nova Scotia (n = 533) and Newfoundland (n = 449) using a cross sectional study design.
Results: More Nova Scotians (24%) than Newfoundlanders (11%) received home care services. In both provinces, most ADL-dependent people do not receive home care services, and most home care users are not ADL dependent. In Newfoundland, home care users were more likely to be ADL dependent and to have dementia; this was not the case in Nova Scotia. In Nova Scotia being over age 85 without a supporter in the same residence, not being married, and having an IADL limitation significantly increased the likelihood of home care use. IADL impaired subjects in Newfoundland were also more likely to receive home care.
Conclusions: If home care is to substitute for institutional care, existing home care programs must be prepared to adapt to a new type of user.

The preoperative delayed memory performance on the Rey-Osterrieth Complex Figure (Lezak, 1983) of 54 patients with complex partial seizures of temporal lobe origin was analyzed using 3 different indices. One index (composite) was derived using a common scoring method that included both spatial and figural aspects of memory in its score. The other two indices were derived emphasizing either spatial or figural aspects of memory for the elements of the figure separately. All 3 indices distinguished between individuals with right-sided (RTLE) and left-sided (LTLE) seizure onset. However, spatial memory was significantly lower than figural memory in individuals with RTLE as compared to those with LTLE. Both the spatial and figural memory indices were significantly lower in the presence of magnetic resonance imaging (MRI) evidence for hippocampal selerosis in individuals with RTLE. Results suggest that while both the spatial and figural aspects of nonverbal memory are sensitive to right hippocampal dysfunction, figural memory may be less vulnerable to the effects of RTLE. We evaluated the abundance and distribution of low-elevation forest birds on windward Hawai'i Island during August 1993-February 1994, and present evidence of changes in the species composition of the forest bird community since 1979. Endemic Hawaiian birds occurred in native-dominated forests as low as 120 m elevation. Non-native species were detected at all survey locations. We observed non-native Saffron Finch Sicalis flaveola, previously unrecorded in Puna. Variable circular plot surveys of Kahauale'a Natural Area Reserve indicated the disappearance of two native species ('I'iwi Vestiaria coccinea and 'O'u Psittitostra psittacea), and two non-native additions (Red-billed Leiothrix Leiothrix lutea and Kalij Pheasant Lophura leucomelana) to the study area since the Hawai'i Forest Bird Survey conducted in 1979. We present evidence that native 'Elepaio Chasiempsis sandwichensis has experienced a decrease in population density and an elevational range contraction since 1979. Surveys indicate Puna's forest bird community has had increasing aliens and declining native species since 1979. The persistence of some native bird species within the range of avian disease vectors such as Culex quinquefasciatus in forests below 1,000 m elevation presents an important enigma that requires additional study.

In 1985, Gualtieri and Hicks proposed the immunoreactive theory to explain the higher prevalence of childhood neurodevelopmental disorders in males. The theory claimed that male fetuses are more antigenic to mothers, resulting in increased immunologic attack on the developing central nervous system, and increased probability of atypical brain development. Individuals with systemic lupus erythematosus (SLE) provide a unique situation in which to investigate this theory. We evaluated the parent-reported prevalence of five developmental problems (stuttering, other speech problems, hyperactivity, attention deficit, and reading problems) in two groups: 154 individuals ages 8–20 years born to women with SLE, drawn from six cities, and 154 controls of comparable age and sex whose mothers did not have SLE. Controls were drawn from a comparison group ascertained from randomly selected schools in one of the cities. Questions about handedness, immune disorders, and pregnancy and birth complications were also evaluated. Children of SLE mothers were shown to have more evidence of developmental difficulties, immune related disorders, and nonrighthandedness. For developmental problems, these findings were most marked in male children of SLE mothers. These results suggest that maternal immunoreactivity, as represented by women with SLE, may present a special risk factor for subsequent learning difficulties in their children, particularly males.
