The proscription of organisations has long been a central feature of legal regimes aimed at the suppression of terrorism. Australia is no exception. Going back many decades, the Commonwealth government has sought to meet the threat of political violence through the proscription of related organisations. In the wake of the September 11 terrorist strikes against New York and Washington, renewed efforts were made for the proscription of organisations in many national jurisdictions (for example, the United Kingdom, United States and Canada) as well as at the international level (for example, through the United Nations and the European Union.

In Australia, the Commonwealth looked directly to the justifications offered by the United Kingdom’s Lord Lloyd of Berwick and Paul Wilkinson just a few years before. In their major Inquiry into Legislation Against Terrorism, Lord Lloyd and Wilkinson presented three principal rationales to explain the role of proscription in the prevention of terrorism: ease of proof; providing a basis for the criminalisation of fundraising and other activities of terrorist groups; and as a clear symbol of ‘public revulsion and reassurance that severe measures [are] being taken’.

Williams v Commonwealth of Australia is a landmark decision of the High Court on the scope of federal executive power in s 61 of the Constitution. The decision is also important for the interpretive methodology adopted by the Court. Notably, each judge based their understanding of s 61 upon federal readings of the Constitution. This methodology raises fresh questions about how the Constitution is to be interpreted, and whether Williams marks a break from orthodox understandings of that task. This article assesses the significance of Williams for constitutional interpretation in Australia, and whether it lays the foundation for a more robust protection of state interests by the High Court.

An Australian Offensive Cyberspace Operations (OCO) capability has emerged as an important sub-component of national power. While significant academic literature exists concerning OCO’s place within the international law of armed conflict, and international law in general, literature regarding domestic law is scarce. Nevertheless, an understanding of the domestic law governing the Australian Defence Force’s (ADF’s) authority to conduct OCO is necessary as the gap in the research potentially exposes the Government and individuals to legal risks that are not well understood. The aim of this article is to analyse the proprietary and constitutional implications of ADF OCO to inspire further research at a time when the Comprehensive review of the legal framework governing the National Intelligence Community is underway. The qualitative research analyses statutory and case law authorities to argue that Australian proprietary and constitutional law creates important implications for ADF OCO. The analysis suggests that these implications oblige the Commonwealth to be careful in balancing its legislative and executive power to provide the ADF with the legal authority to conduct OCO. The research finds that OCO impinges upon the proprietary rights of others, requiring legal authority which, if created under statute, generates an obligation to compensate proprietors under just terms. However, if the authority arises under the executive power, then the obligation to compensate may not apply. Further, such executive powers may exist under a royal war prerogative. As a corollary, we suggest that in an escalated conflict environment, the ADF may be able to conduct OCO without any legislative amendments to the criminal law although express immunities would be preferred.

The growth of the ‘gig economy’ has prompted debate about the regulation of arrangements to obtain work and income through digital labour platforms. For platform workers who are classified as freelancers or independent contractors, rather than as employees, one possibility is to invoke general laws on the fairness of contractual terms to challenge the inclusion of harsh or one-sided provisions in the contracts of adhesion typically drafted and imposed by digital platforms. To test the potential application of one such regime, in pt 2-3 of the Australian Consumer Law (‘ACL’), we systematically analyse the terms and conditions used by various platforms intermediating work performed in Australia, within and across different industry sectors. Our analysis uncovers many examples of terms that are designated in s 25 of the ACL as potentially unfair or that have been identified as potentially problematic by the Australian Competition and Consumer Commission (‘ACCC’). We also examine the practical difficulties confronting a worker seeking to challenge the fairness of their contract terms, against the background of recent reforms to enhance the efficacy of this regime.

We present a re-discovery of G278.94+1.35a as possibly one of the largest known Galactic supernova remnants (SNRs) – that we name Diprotodon. While previously established as a Galactic SNR, Diprotodon is visible in our new Evolutionary Map of the Universe (EMU) and GaLactic and Extragalactic All-sky MWA (GLEAM) radio continuum images at an angular size of $3{{{{.\!^\circ}}}}33\times3{{{{.\!^\circ}}}}23$, much larger than previously measured. At the previously suggested distance of 2.7 kpc, this implies a diameter of 157$\times$152 pc. This size would qualify Diprotodon as the largest known SNR and pushes our estimates of SNR sizes to the upper limits. We investigate the environment in which the SNR is located and examine various scenarios that might explain such a large and relatively bright SNR appearance. We find that Diprotodon is most likely at a much closer distance of $\sim$1 kpc, implying its diameter is 58$\times$56 pc and it is in the radiative evolutionary phase. We also present a new Fermi-LAT data analysis that confirms the angular extent of the SNR in gamma rays. The origin of the high-energy emission remains somewhat puzzling, and the scenarios we explore reveal new puzzles, given this unexpected and unique observation of a seemingly evolved SNR having a hard GeV spectrum with no breaks. We explore both leptonic and hadronic scenarios, as well as the possibility that the high-energy emission arises from the leftover particle population of a historic pulsar wind nebula.

Shiga toxin-producing Escherichia coli (STEC) is a group of bacteria that causes gastrointestinal illness and occasionally causes large foodborne outbreaks. It represents a major public health concern due to its ability to cause severe illness which can sometimes be fatal. This study was undertaken as part of a rapid investigation into a national foodborne outbreak of STEC O145. On 22 May 2024, United Kingdom (UK) public health agencies and laboratories identified an increase in stool specimens submissions and patients testing positive for Shiga toxin-producing E. coli (STEC). Whole genome sequencing (WGS) identified serotype O145:H28 stx2a/eae belonging to the same five single nucleotide polymorphism (SNP) single linkage cluster as the causative agent. By 3 July 2024, 288 cases had been linked to the cluster. Most cases were adults (87%) and females (57%), 49% were hospitalized with a further 10% attending emergency care. Descriptive epidemiology and analytical studies were conducted which identified consumption of nationally distributed pre-packed sandwiches as a common food exposure. The implicated food business operators voluntarily recalled ready-to-eat sandwiches and wraps containing lettuce on 14 June 2024.

Even amidst a decline in religious affiliation, nearly half of the U.S. population still attends religious services at least once a month, and congregations remain the single largest non-profit organizational type across the nation. Therefore, congregational influence on political attitudes and behavior is a crucial line of inquiry. We analyze interviews of 94 congregational leaders to better understand why they address or avoid political issues when preaching. Our research reveals that clergy use theological and pragmatic reasoning to determine whether they explicitly include political discourse in their sermons. Our findings are noteworthy in that clergy from a wide range of religious traditions use similar reasoning, and the same rationale can lead different clergy to adopt contrasting approaches to political content in sermons. Thus, this paper provides nuanced insight into the relationship between religion and politics and may help foster greater mutual understanding in a deeply divided political and social climate.

We developed automated ablation stakes to measure colocated in situ changes in relative glacier-surface elevation and climatological drivers of ablation. The designs, refined over 10 years of development and deployments, implement open-source hardware and common building materials. The ablation stakes record distance to the snow/ice surface, air temperature and relative humidity every 1–15 min. Using these high-frequency data, we demonstrate that melt factors calculated using standard melt-rate vs temperature regressions converge over averaging windows of approximately 12 h or greater. Furthermore, we evaluate an integral approach to estimating temperature-index melt factors for ablation. In a test case on Glaciar Perito Moreno, Argentina, this integral approach reveals an overall positive-degree-day melt factor of 7.5 mm w.e. $^\circ$C−1 d−1. We describe four deployments with iteratively improved designs and provide a list of materials required to construct an automated ablation stake.

We present the Sydney Radio Star Catalogue, a new catalogue of stars detected at megahertz to gigahertz radio frequencies. It consists of 839 unique stars with 3 405 radio detections, more than doubling the previously known number of radio stars. We have included stars from large area searches for radio stars found using circular polarisation searches, cross-matching, variability searches, and proper motion searches as well as presenting hundreds of newly detected stars from our search of Australian SKA Pathfinder observations. The focus of this first version of the catalogue is on objects detected in surveys using SKA precursor and pathfinder instruments; however, we will expand this scope in future versions. The 839 objects in the Sydney Radio Star Catalogue are distributed across the whole sky and range from ultracool dwarfs to Wolf-Rayet stars. We demonstrate that the radio luminosities of cool dwarfs are lower than the radio luminosities of more evolved sub-giant and giant stars. We use X-ray detections of 530 radio stars by the eROSITA soft X-ray instrument onboard the Spectrum Roentgen Gamma spacecraft to show that almost all of the radio stars in the catalogue are over-luminous in the radio, indicating that the majority of stars at these radio frequencies are coherent radio emitters. The Sydney Radio Star Catalogue can be found in Vizier or at https://radiostars.org.

Flowering rush (Butomus umbellatus L.) is an emergent perennial monocot that has invaded aquatic systems along the U.S.–Canadian border. Currently, there are two known cytotypes of flowering rush, diploid and triploid, within the invaded range. Although most studies have focused on the triploid cytotype, little information is known about diploid plants. Therefore, phenology and resource allocation were studied on the diploid cytotype of flowering rush in three study sites (Mentor Marsh, OH; Tonawanda Wildlife Management Area, NY; and Unity Island, NY) to understand seasonal resource allocation and environmental influences on growth, and to optimize management strategies. Samples were harvested once a month from May to November at each site from 2021 to 2023. Plant metrics were regressed to air temperature, water temperature, and water depth. Aboveground biomass peaked from July to September and comprised 50% to 70% of total biomass. Rhizome biomass peaked from September to November and comprised 40% to 50% of total biomass. Rhizome bulbil densities peaked from September to November at 3,000 to 16,000 rhizome bulbils m−2. Regression analysis resulted in strong negative relationships between rhizome starch content and air temperature (r2 = 0.52) and water temperature (r2 = 46). Other significant, though weak, relationships were found, including a positive relationship between aboveground biomass and air temperature (r2 = 0.17), a negative relationship between rhizome bulbil biomass and air temperature (r2 = 0.18) and a positive relationship between leaf density and air temperature (r2 = 0.17). Rhizomes and rhizome bulbils combined stored up to 60% of total starch, and therefore, present a unique challenge to management, as these structures cannot be reached directly with herbicides. Therefore, management should target the aboveground tissue before peak production (July) to reduce internal starch storage and aim to limit regrowth over several years.

From early on, infants show a preference for infant-directed speech (IDS) over adult-directed speech (ADS), and exposure to IDS has been correlated with language outcome measures such as vocabulary. The present multi-laboratory study explores this issue by investigating whether there is a link between early preference for IDS and later vocabulary size. Infants’ preference for IDS was tested as part of the ManyBabies 1 project, and follow-up CDI data were collected from a subsample of this dataset at 18 and 24 months. A total of 341 (18 months) and 327 (24 months) infants were tested across 21 laboratories. In neither preregistered analyses with North American and UK English, nor exploratory analyses with a larger sample did we find evidence for a relation between IDS preference and later vocabulary. We discuss implications of this finding in light of recent work suggesting that IDS preference measured in the laboratory has low test-retest reliability.

We aimed to estimate the secondary attack rate of mpox among UK household contacts and determine factors associated with transmission to inform public health management of contacts, during the global outbreak in 2022. Information was collected via NHS and public health services and included age, gender, place of residence, setting, and type of contact. Aggregate information was summarized for the UK. Record level data was combined for England, Wales and Northern Ireland, and multivariable logistic regression was used to determine factors associated with transmission. The secondary attack rate among UK household mpox contacts was 4% (60/1 526). Sexual contact with the index case was associated with a 11-fold increase in adjusted odds of becoming a case in England, Wales, and Northern Ireland (95% CI 5.5–22, p < 0.001). Household contacts outside of London had increased odds compared to London residents (adjusted OR 2.9, 95%CI 1.6–5.4, p < 0.001), while female contacts had reduced odds of becoming a case (aOR: 0.41, 95% CI: 0.15–0.95). We found a low overall secondary attack rate among household mpox contacts with strong evidence of increased transmission risk associated with sexual contact. This evidence will inform the risk assessment of contacts and support prioritization of those with close intimate contact for follow up.

If livestock at risk of poor welfare could be identified using a risk assessment tool, more targeted response strategies could be developed by enforcement agencies to facilitate early intervention, prompt welfare improvement and a decrease in reoffending. This study aimed to test the ability of an Animal Welfare Risk Assessment Tool (AWRAT) to identify livestock at risk of poor welfare in extensive farming systems in Australia. Following farm visits for welfare- and non-welfare-related reasons, participants completed a single welfare rating (WR) and an assessment using the AWRAT for the farm just visited. A novel algorithm was developed to generate an AWRAT-Risk Rating (AWRAT-RR) based on the AWRAT assessment. Using linear regression, the relationship between the AWRAT-RR and the WR was tested. The AWRAT was good at identifying farms with poor livestock welfare based on this preliminary testing. As the AWRAT relies upon observation, the intra- and inter-observer agreement were compared in an observation study. This included rating a set of photographs of farm features, on two occasions. Intra-observer reliability was good, with 83% of Intra-class Correlation Coefficients (ICCs) for observers ≥ 0.8. Inter-observer reliability was moderate with an ICC of 0.67. The AWRAT provides a structured framework to improve consistency in livestock welfare assessments. Further research is necessary to determine the AWRAT’s ability to identify livestock at risk of poor welfare by studying animal welfare incidents and reoffending over time.

The objective of this study was to identify factors more commonly observed on farms with poor livestock welfare compared to farms with good welfare. Potentially, these factors may be used to develop an animal welfare risk assessment tool (AWRAT) that could be used to identify livestock at risk of poor welfare. Identifying livestock at risk of poor welfare would facilitate early intervention and improve strategies to promptly resolve welfare issues. This study focuses on cattle, sheep and goats in non-dairy extensive farming systems in Australia. To assist with identifying potential risk factors, a survey was developed presenting 99 factors about the farm, farmers, animals and various aspects of management. Based on their experience, key stakeholders, including veterinarians, stock agents, consultants, extension and animal welfare officers were asked to consider a farm where the welfare of the livestock was either high or low and rate the likelihood of observing these factors. Of the 141 responses, 65% were for farms with low welfare. Only 6% of factors had ratings that were not significantly different between high and low welfare surveys, and these were not considered further. Factors from poor welfare surveys with median ratings in the lowest 25% were considered potential risks (n = 49). Considering correlation, ease of verification and the different livestock farming systems in Australia, 18 risk factors relating to farm infrastructure, nutrition, treatment and husbandry were selected. The AWRAT requires validation in future studies.

A novel wall-mounted far ultraviolet-C (UV-C) light technology providing automated delivery of far UV-C only when people are not present reduced methicillin-resistant Staphylococcus aureus in a patient room and equipment room. The safety feature that discontinues far UV-C output when people are detected was effective in preventing far UV-C exposure.
