This essay examines the far-reaching attack on individualism and property rights which characterized the Progressive Era of the early twentieth century. Scholars and political figures associated with Progressivism criticized the individualist values of classical liberalism and rejected the traditional notion of limited government espoused by the framers of the Constitution. They expressed great confidence in regulatory agencies, staffed by experts, to effectuate policy. Progressives paved the way for the later triumph of statist ideology with the New Deal in the 1930s.

The essay traces the sources of the Progressive antipathy to individual rights to the influence of Bismarck’s program in Imperial Germany and the Social Gospel theology. It gives attention to the views of leading Progressive intellectuals who stressed the perceived need for increased governmental power and governance by an educated elite. The essay also explores the impact of Progressivism on constitutional law, arguing that the rise of “sociological jurisprudence,” with its skepticism about courts and stress on judicial deference to legislative judgments, served to advance the Progressive political agenda. Progressives looked with disfavor on any constitutional doctrine which curtailed governmental authority. The Progressive movement left a lasting legacy of diminished regard for individualism and a jurisprudence which stripped property of muscular constitutional protection.

Preliminary data are presented from the NIMH Collaborative Study on the psychobiology of depression, biological studies, dealing with relationships between the pre-treatment levels of the neurotransmitter metabolites 3-methoxy-4-hydrophenethyleneglycol (MHPG), 5-hydroxyindoleacetic acid (5-HIAA) and homovanillic acid (HVA) and the subsequent therapeutic response of depressed patients to imipramine or amitriptyline. Eighty-seven depressed patients were studied during pre-treatment and treatment periods. It has been found that (1) both low pre-treatment urinary MHPG and low CSF 5-HIAA values are associated with a response to imipramine; these relationships were not artefacts due to sex or age; (2) there were no significant relationships between pre-treatment urinary MHPG, CSF MHPG, 5-HIAA, or HVA values and the subsequent response, or failure of response, to amitriptyline; (3) there was not a bimodal distribution for CSF 5-HIAA. For both males and females, there were positive and statistically significant correlations between CSF MHPG and urinary MHPG; for the females, there were positive and significant correlations between both urinary and CSF MHPG and CSF 5-HIAA. The theoretical and practical implications of these findings are discussed.

There are many reports which suggest that patients with affective illness (mania and/or depression) have abnormalities in the functioning of one or more neurobiological systems. At a conference convened by the Clinical Research Branch, Division of Extramural Research Programs, National Institute of Mental Health, these findings were reviewed and some of the factors impeding movement towards a more complete and integrated view of the functioning of neurobiological systems in patients with mania or depression were identified. As a result, a multi-research centre, collaborative approach to the study of the psychobiology of affective disorders was developed. In this collaborative programme, which has now been underway for several years, the focus has been upon: (a) the assessment of the functioning of several different types of biological systems in the same patient, both before and during treatment; (b) obtaining a reasonably large number of patients and comparison subjects; and (c) the use within and across centres of standardized diagnostic categories and behavioural rating methodologies. In this paper the history, background, and rationale for this collaborative effort are reviewed. Those biological systems chosen for study are noted, and issues such as reliability and validity of diagnoses, measurement of state variables, assessment of change with treatment, and logistical and coordinating problems are discussed.

Free speech has been treated as a preeminent constitutional right in the United States for more than half a century. The rights of property owners, on the other hand, have received little constitutional protection since the New Deal period of the 1930s. This modern dichotomy is particularly striking because it obscures an older constitutional tradition that equated economic liberty and freedom of expression. This tradition saw both property rights and speech rights as essential to the protection of personal freedom by restraining the power of government.

A series of electroactive spinel compounds, LiMn2-xCuxO4 (0.1 ≤ x ≤ 0.5) has been studied by crystallographic, spectroscopie and electrochemical methods and by electron-microscopy. These LiMn2-xCuxO4 spinels are nearly identical in structure to cubic LiMn2O4 and successfully undergo reversible Li intercalation. The electrochemical data show slight shifts to higher voltage for the delithiation reaction that normally occurs at 4.1 V in standard Li1−xMn2O4 electrodes (1 ≥ x ≥ 0) corresponding to the oxidation of Mn3+ to Mn4+. The data also show a remarkable reversible electrochemical process at 4.9 V which is attributed to the oxidation of Cu2+ to Cu3+. The inclusion of Cu in the spinel structure enhances the electrochemical stability of these materials upon cycling. The initial capacity of LiMn2-xCuxO4 spinels decreases with increasing x from 130 mAh/g in LiMn2O4 (x=0) to 70 mAh/g in “LiMn1.5Cu0.5O4”(x=0.5). Although the powder X-ray diffraction pattern of “LiMn1.5Cu0.5 O4” shows a single-phase spinel product, neutron diffraction data show a small, but significant quantity of an impurity phase, the composition and structure of which could not be identified. X-ray absorption spectroscopy was used to gather information about the oxidation states of the manganese and copper ions. The composition of the spinel component in the LiMn1.5Cu0.5O4 was determined from X-ray diffraction and XANES data to be Li1.01Mn1.67Cu0.32O4 suggesting, to a best approximation, that the impurity in the sample was a lithium-copper-oxide phase.
