Domestic law, case law and policies play a decisive yet underestimated role in ensuring that partnered operations are carried out in compliance with international law. Research on the legal framework of partnered operations has so far focused on clarifying existing and emerging obligations at the international level. Less attention has been devoted to understanding whether and how domestic legal systems integrate international law into national decision-making which governs the planning, execution and assessment of partnered operations. This article tries to fill the gap by focusing on the practice of selected States (the United States, the United Kingdom, Denmark, Germany and Italy), chosen for their recent or current involvement in partnered operations. By using the International Committee of the Red Cross's “support relationships” framework and based on a comparative analysis of practice, the study seeks to evaluate the effectiveness of national laws, case law and policies according to their ability to prevent or mitigate the risk of humanitarian consequences posed by partnered warfare.

Digital technologies are changing the very processes we use to serve affected people. In this issue, the Review has chosen to profile the testimonies of two affected people, based in Côte d'Ivoire and the Democratic Republic of the Congo (DRC), who expressed their opinions on two digitally driven projects by the International Committee of the Red Cross (ICRC); these projects respectively facilitate restoring and maintaining family links.1 Being of the view that affected people should speak for themselves and that their testimonies should not be cut down or “reworked” to fit the purposes of humanitarians and their outputs, in this section the Review has directly translated the quotes we received from field delegations, word for word, sentence for sentence, making no changes except for the redaction of information to ensure the extent of anonymity requested. By keeping the framing of the quotes to a minimum, we aim to ensure that the Review serves as a platform for the voices of the featured affected people.

Attaher Zacka Maïga was born on 10 May 1963 in Bia, Bourem Cercle, Gao Region, Mali. He has spent his life in the service of the International Red Cross and Red Crescent Movement, joining the Mali Red Cross as a volunteer in 1987 before working for the International Federation of Red Cross and Red Crescent Societies as a nutritionist in a pilot centre for nutritional recovery and education in Bourem from January 1988 to June 1990. In 1990 and 1991 he acted as consultant to a number of organizations, including World Vision and UNICEF.

In April 1992, Attaher Maïga joined the International Committee of the Red Cross (ICRC) as a “resident” (i.e. local) employee. Since then, he has held many positions. From 1996 to 2000, he was in charge of the Gao office, which employed almost 100 staff, both resident and “mobile” (expatriate). He then took charge of the ICRC's programmes in northern Mali from 2001 to 2006, ran the organization's office in the Malian capital Bamako from 2007 to 2008 and was responsible for the Mali communication programme between 2009 and 2011. From November 2011 to November 2014, he was head of the ICRC's northern Mali sub-delegation, one of the first resident employees to lead an ICRC sub-delegation. Since 2015, Attaher Maïga has been Networking Coordinator for the ICRC's Mali delegation.

In 1996, Mr Maïga initiated the ICRC's post-conflict programmes in his country, covering the fields of agriculture, veterinary services and health. In 2009, he launched a pilot migrant project in Kidal, northern Mali. These much-appreciated initiatives resulted in his being invited to participate in the 2010 Montreuil meeting, which laid the foundations for the reforms currently underway.

Attaher was the first Mali focal point for the ICRC's Unit for Global Affairs. This role gave him a deeper understanding of trends in the Islamic world and enabled him to help the ICRC adjust its dialogue with Jihadist armed groups. Our interview with Mr Maïga highlights his extensive experience with one of the oldest humanitarian organizations and is an opportunity for him to share his understanding of the ICRC's interaction with the armed groups that controlled northern Mali in 2012, when he was representing the ICRC in the region.

In this Q&A, the Review talks to Delphine van Solinge and Massimo Marelli of the International Committee of the Red Cross (ICRC). Van Solinge is the ICRC's focal point for understanding how digital technologies and the spread of harmful information affect populations living in conflict environments, and what this means for humanitarian action. To this end, her portfolio is focused on exploring, on behalf of the ICRC and through partnerships, how to mitigate the risks that digital technologies bring in humanitarian settings and ensure relevant protection responses in the digital age. Marelli is Head of the ICRC's Data Protection Office (DPO). During his tenure with the ICRC, the organization has chartered new pathways for how it can carry out its operational work, while ensuring that the data of the affected people which it serves, as well those of its employees, are well protected.

During this conversation, van Solinge and Marelli discuss how their areas of work complement and reinforce each other, forming two halves of the same coin with regard to how digital information and data can both be used for positive change and misused in humanitarian settings. Marelli highlights how humanitarian organizations process, protect and use data and digital information. Van Solinge discusses how through misinformation, disinformation and hate speech, information can be manipulated and spread using digital technologies – particularly in the age of the COVID-19, when populations are more reliant on digital communication technologies. Among the issues they discuss are how digital technologies can be used positively, the ethical considerations that humanitarian organizations should take into account, and the possible paths forward for public–private sector collaborations on this theme.

In recent non-international armed conflicts in countries such as the Central African Republic, Iraq, Libya, Nigeria, South Sudan, Syria, Ukraine and Yemen, various non-State armed groups (NSAGs) have exercised control over territory and people living therein. In many cases, and for a variety of reasons, NSAGs perform some form of governance in these territories, which can include the maintenance of order or the provision of justice, health care, or social services. The significance of such measures became particularly apparent when in 2020 not only governments but also armed groups took steps to halt the spread of the COVID-19 pandemic. This article examines key legal issues that arise in these contexts. First, it analyzes the extent to which international humanitarian law protects the life and dignity of persons living under the control of NSAGs, rebutting doubts as to whether this field of international law has a role in regulating what is sometimes called “rebel governance”. Second, it provides a brief overview of aspects of the lives of people in armed group-controlled territory that are addressed by international humanitarian law and aspects that instead fall into the realm of human rights law. Third, the article discusses whether and to what extent human rights law can be said to bind NSAGs as a matter of law and flags issues that need further attention in current and future debates.

The destruction of cultural heritage in armed conflicts has gained increasing political momentum and visibility over the last two decades. Syria, Iraq and Mali, among others, have witnessed the intentional destruction of their cultural heritage by non-State armed groups (NSAGs) that have invoked Islamic law and principles to legitimize their actions. The response of the international community has predominantly focused on the material aspect, to the detriment of the significant impact on the associated intangible manifestation of cultural heritage in local communities. This article argues that several Islamic legal rules and principles may, more adequately than international humanitarian law, safeguard the intangible dimension of cultural heritage in certain contemporary armed conflicts in Muslim contexts. It aims to demonstrate the importance of drawing from multiple legal traditions in order to enhance the protection of intangible cultural heritage in armed conflicts and to strengthen engagement with the relevant NSAGs.

Cash transfers have changed the way the humanitarian sector delivers assistance, and at the same time, digitalization is changing the way our world works in fundamental ways. The digitalization of cash means that the simple click of a button can put money in the hands of hundreds of thousands, if not millions, of people within minutes. Digital payments have been a game changer, opening the door to faster and more efficient delivery of life-saving assistance. Although physical currency will not disappear with the rise of digital payments, it is essential to balance the benefits of these digital processes with the risks. As humanitarians, we need to articulate what “do no harm” means in the digital age, applying this equally to the way we use digital payments to support people affected by armed conflicts and other situations of violence.

This article examines the presence of 605 armed groups in today's conflict environment by bringing new evidence based on internal research. It looks in particular at the way these non-State entities provide varying degrees of services to the population in the spaces that they control, and how this might impact the way a humanitarian organization like the ICRC engages with them in a dialogue over time. This model of analysis is then used to situate and better explain armed groups’ positions on the COVID crisis.

The use of armed escorts to humanitarian convoys delivering humanitarian assistance potentially increases the targeting of these convoys, yet so far this use has not been examined from the perspective of international humanitarian law (IHL). This article attempts to determine whether the resort to armed escorts is in line with the principle of passive precautions under IHL, how the principle of proportionality could apply in cases of attack against the escort, and whether the convoy turns into a military objective when escorted. Finally, the article tackles the limitations of such a framework in order to define the situations it covers.

This article examines whether and how non-State armed groups, as distinct entities, might be required to provide reparations for their violations of international humanitarian law. It shows that the possibility of holding armed groups to reparations is marked by uncertainty in international law. This complex question calls for clarification. In building on these observations, the article explores how the duty to provide reparations by armed groups could be operationalized as a matter of lex ferenda. This exercise involves examining how such a duty could be conceptualized and put into practice. From this discussion, a multi-faceted proposal emerges, which draws upon existing approaches in international law and responds to the particular challenges presented by armed groups. The article ends by considering the implications of the proposal.

As belligerent parties, non-State armed groups (NSAGs) contribute to environmental damage in non-international armed conflicts. Drawing from the actual practice and doctrine of NSAGs, this article unpacks the legal and policy framework for engaging them on the protection of the environment. It analyzes the international humanitarian law rules protecting the environment binding on NSAGs. To improve environmental protection, a model of environmental responsibilities under international human rights law and international environmental law based on the NSAG's level of territorial control is suggested, as a matter of policy. This article then explores how to engage NSAGs on the legal and policy framework identified and proposes a model unilateral declaration for the protection of the natural environment.

The COVID-19 pandemic has served as a wake-up call for humanitarian aid actors to reconsider data collection methods, as old ways of doing business become increasingly obsolete. Although access to information on the affected population is critical now more than ever to support the pandemic response, the limitation of aid workers’ presence in the field imposes hard constraints on relief projects. In this article, we consider how aid actors can use “big data” as a crisis response tool to support humanitarian projects, in cases when the General Data Protection Regulation is applicable. We also provide a framework for examining open-source platforms, and discuss the advantages and privacy challenges of big data.

Digital technological innovations make new types of responses to conflict-related sexual violence (CRSV) possible, bringing with them both potential promises and pitfalls. Aiming to provide a conceptual starting point for further analysis, this article problematizes the trend towards data extraction in exchange for aid, protection and justice, and argues for the importance of complementing technology-driven approaches to the struggle against CRSV with the inclusion of strategies for user participation and investment in digital literacy as key aspects of the response. To explore how the digital turn shapes the struggle against CRSV, the article offers a three-part analytical framework. First, the article unpacks how digital technologies create corresponding “digital bodies” – comprised of images, information, biometrics and other data stored in digital space – which represent the bodies of individuals affected by sexual violence, and which interplay with the risks posed upon the physical bodies of those facing CRSV. Second, the article maps out the role of digital technologies in a cycle of intervention, including prevention of, response to, documentation of and accountability for CRSV. Third, recognizing the increasing importance of data governance to the struggle against CRSV, the article considers how divergent humanitarian, human rights and international criminal law approaches to data may create different pathways for CRSV data. This could also give rise to new tensions in how international actors approach CRSV.

The search for the more than 90,000 disappeared persons in Mexico has highlighted the need to establish relations of collaboration with organized crime groups in order to access not only relevant information to clarify the fate and whereabouts of the missing, but also territories under the control of organized crime groups for carrying out field searches. Given the ineffectiveness of formal, prosecutorial approaches and the considerable success of grassroots, victim-led search strategies, this paper argues for the need for a broader humanitarian approach to the search for the missing that is victim-centred and complementary to accountability mechanisms. The article advances a proposal to formalize this approach through the International Committee of the Red Cross's (ICRC) involvement in search activities, given the ICRC's unique organizational nature, expertise and humanitarian mandate.

Atrocities by non-State armed groups (NSAGs) often capture international attention, but efforts to repair the harm they have caused are often overlooked. This article traces out some of the practices and tensions in NSAGs making reparations during wartime and in post-conflict transitions. It argues that engaging in reparations for acts committed by NSAGs can not only encourage greater compliance with international humanitarian law but also build support amongst civilian populations during armed conflict and facilitate ex-fighter reintegration at the end of hostilities. Drawing from interviews with a number of armed groups, the article also suggests that engaging with the armed group's organization rather than just individuals themselves can be an effective way to collectively mobilize a group's motivation and capacity to deliver on reparations, including recovery of disappeared persons, restitution of property and apologies. As such, this article seeks to contribute to a deeper understanding of reparation practices by NSAGs in order to see how reparations can be mediated and a hierarchy of reparation obligations developed.

The State-centric bias in proportionality in international humanitarian law, where non-State armed groups (NSAGs) are expected to adhere to the same rigour of proportionality as States, regardless of how unrealistic that expectation is, has not often been considered in ideas to improve compliance with proportionality. This article puts forth three proposals – a Comprehensive Proportionality Assessment Framework, capacity-building for military actors, and rapid multidisciplinary assessment teams – that aim to reduce State-centric bias and strengthen proportionality compliance not just for States but for all parties to conflict, including NSAGs.

There is a persistent belief in the power of media images to transform the events they depict. Yet despite the instant availability of billions of images of human suffering and death in the continuous and connective digital glare of social media, the catastrophes of contemporary wars, such as in Syria and Yemen, unfold relentlessly. There are repeated expressions of surprise by some in the West when the dissemination of images of suffering and wars, particularly in mainstream news media, does not translate into a de-escalation of conflict.

In this article I consider today's loosening of the often presumed relationship between media representation, knowledge and response under the conditions of “digital war”. This is the digital disruption of the relationship between warfare and society in which all sides participate in the uploading and sharing of information on, and images and videos of, conflict.

Is it the case that the capacity of images of human injury and death to bring about change, and the expectation that they would stir practical intervention in wars, is and has been exaggerated? Even if we are moved or shocked upon being confronted by such images, does this translate into some form of action, individual or otherwise? In this article I contend that the saturation of information and images of human suffering and death in contemporary warfare has not ushered in a new era of “compassion fatigue”. Rather, algorithmically charged outrage is a proxy for effects. It is easy to misconstrue the velocity of linking and liking and sharing as some kind of mass action or mass movement.

Humanitarian catastrophes slowly unfold in an age of continuous and connective digital glare, and yet they are unseen. If the imploded battlefield of digital war affording the most proximate and persistent view of human suffering and death in history cannot ultimately mobilize radically effective forms of public response, it is difficult to imagine what will.
