John Stuart Mill's commitment to liberty and individual development is one of the most exoteric themes of his moral and political philosophy. But the linkages between this commitment to liberty and development and Mill's conception of utility and principles of the good are not as commonly recognized. As part of a more general transformation of his utilitarianism, Mill repudiated Bentham's principles of the good and instead adopted a more sophisticated form of hedonism. While Bentham admits only the total quantity of pleasure as contributing to value, Mill expands the circle to admit quality or kind of pleasure as well into the value reckoning. I have elsewhere interpreted and defended Mill's qualitative hedonism, and in this paper I can offer only a brief overview of that account and must largely assume its plausibility. Bentham and Mill agree that only pleasurable experiences and the absence of painful experiences have value and so both are called hedonists. But they have very different views about what properties of pleasures makes them valuable, or in other words what are the good-making properties of pleasure. Bentham thinks that only intensity and duration, or quantity, are good-making properties of pleasures, and thus he includes only these properties in measuring value. As a consequence, in the context of value measurement he is not interested in the kinds of things in which people take pleasure. But Mill is a qualitative hedonist, and thinks that the quality or kind of pleasure is also a good-making characteristic and thus should be included in value measurement. The things that are sources of pleasure matter to Mill.

L'objet de cet article est triple. En premier lieu, il s'agit d'etablir les limites du jugement judiciaire et de montrer que ces limites sont néces-saires à la justice telle qu'elle est entendue par les tribunaux. Ceux-ci ne peuventjuger qu'en fonction de règles de droit préexistantes et selon des procédures définies. En deuxième lieu, il s'agit de critiquer le recours abusif au jugement judiciaire. Pour éviter des débats politiques ou pour décharger le gouvernement, il arrive que l'on confie à des tribunaux ou à des instances quasi judiciaires, la tâche de trancher un litige sur la base de règies de droit insuffisantes ou trop générates. Ou bien on leur demande de résoudre des problèmes qui dépassent leurs compétences. En troisième lieu, cet article traitera de la différence entre les fonctions judiciaires dans I'Etat moderne et les fonctions analogues dans les sociétes sans Etat. Dans ces dernières, l'arbitrage joue un très large rôle, qui semble contraster avec le rôle étroit assigné aux tribunaux dans nos sociétés.

Today a “new” field of philosophy has emerged which can be called simply “The Philosophy of Man and Woman”. Paradoxically, it is a field of study with a long and impressive history which began when the pre-Socratic philosophers first questioned their own identity in the midst of the world. Their questions fall into four broad areas:

1. How is the male “opposite” to the female?

2. What roles do male and female play in the generation and identity of offspring?

3. Are women and men wise in the same or different ways?

4. Are women and men good in the same or different ways?

Trois idées générales admises par Sr Prudence Allen font l'objet de notre commentaire. Ce sont I'interpretation égalita-riste des idées de Platon quant aux différences sexuelles, la neutralité du concept d'homme et 1'interpretation philosophique de la complémenta-rite des sexes comme modèle des relations égalitaires.

I appreciate very much the thoroughness with which Jocelyne St-Arnaud has analyzed the text of my paper. As she points out, the major source of difference between our approach to the authors under consideration derives from a preference for an ethical and political perspective on her side and a preference for a metaphysical perspective on mine. However, there are a few key points in interpretation that need to be addressed which go beyond this central difference in orientation.

Le nominalisme est « le refus d'admettre toute entité autre qu'indivi-duelle » (Goodman, 1977, 26). II doit, pour justifier la simplicité de son ontologie, proposer une théorie de laconnaissance et une théorie sémantique qui ne présupposent ni l'une ni l'autre l'existence réelle des univer-saux. Certaines des voies qui s'ouvrent à cette entreprise délicate ont été systématiquement explorées vers la fin du Moyen Age et il y a tout à parier que, malgré les ruptures épistémologiques, les révolutions scientifiques et autres changements d'epistémè, les nominalistes contemporains pourraient encore profiter de quelque façon de l'immense travail théorique accompli par leurs prédécesseurs médiévaux. C'est dans cet esprit que je voudrais procéder à une reconstruction sommaire de la théorie sémantique avancée au début du quatorzième siècle par le Fran-ciscain Guillaume d'Occam (12857?–1349). Je ne m'engagerai pas dans une comparaison détaillée entre Occam et les auteurs contemporains, mais j'essaierai de présenter sans en trahir l'esprit la sémantique occa-miste de manière à en faire apparaître la pertinence pour les débats actuels. II serait possible, me semble-t-il, d'aller encore plus loin dans cette voie en mettant à profit les techniques formelles récentes pour axiomatiser la théorie d'Occam. Pour l'instant cependant, je me limiterai à une présentation plutôt informelle.

G. A. Cohen in “More on Exploitation and the Labour Theory of Value” defends the thesis that the Marxist charge of exploitation against the capitalist cannot be supported by way of the labour theory of value. He suggests an alternative, non-labour-theoretic argument for this charge which depends on premises he takes to be more obvious than the labour theory of value. Cohen claims that his argument (which he calls the “Plain Argument”) is the only way a Marxist couldjustify attributions of “exploitation” to the capitalist, if any such justification is possible. In this paper, I will argue that, given Cohen's objections to the labour-theoretic argument, his “Plain Argument” itself retains too great a similarity to that argument. A new interpretation of the basis of the charge of exploitation is offered which requires neither the labour theory nor that which is dubious in Cohen's formulation.

Foundations of Illocutionary Logic (FIL) de John Searle et Daniel Vanderveken constitue, à ma connaissance, la première suggestion sérieuse d'un cadre formel destiné à l'élaboration d'une logique de l'illocutoire. Les phénomènes illocutoires sont en effet d'une telle com-plexité que, souvent, les schèmes explicatifs proposés n'ont qu'une valeur très locale et ne constituent une explication que pour quelques exemples bien précis, ceux qui justement ont servi de base empirique sur laquelle ces schèmes se sont élaborés. La prévention de FIL est tout autre. On ne saurait en aucun cas faire un reproche de provincialisme aux auteurs dont le but explicite est d'élaborer un véritable cadre théorique général à l'intérieur duquel tous les phénomènes illocutoires pourront trouver une explication.

This remarkable reconstruction of Søren Kierkegaard's (SK) work based on a reading of original Danish sources could have been entitled Phenomenology of (Finite) Spirit or, perhaps, Itinerarium Cordis Ad Deum. In ten chapters it attempts to uncover SK's ethico-religious understanding of the humanjourney towards the transcendent God. It is a journey away from speculative absorption in nature and universal history, away from the hubris of poetical self-creation, away even from ethical awareness of the universally human and a kind of Pelagian self-confidence in one's ability to do the good. Thejourney ends with the recognition of one's own powerlessness and nothingness—a recognition that can lead either to prideful despair or to humble faith.

Nuclear War, edited by Fox and Groarke, is one of five recent anthologies containing new essays by philosophers on the subject of nuclear war. The Blake and Pole volumes, containing essays mainly by British philosophers, are distinguished by unrelenting and comprehensive opposition to British and American policy, and by the fame of the contributors, which include Anthony Kenny, Michael Dummett, and Bernard Williams. The Chicago volume contains a number of excellent papers by philosophers and the added bonus of nine papers by established specialists in national security issues; it attempts, with partial success, to cover the full range of strategic nuclear options. The Cohen and Lee and the Fox and Groarke volumes consist largely of papers by strategic outsiders far from the centres of political power; the debate in these volumes is not between the principal versions of nuclear deterrence but between nuclear deterrence in any form and some scheme that transcends the present arrangement of mutually deterring superpowers. Of these last two books, Cohen and Lee contains relatively longer and more detailed essays.
