Abstract. I argue in this paper that there are certain similarities between Catharine MacKinnon, on the one hand, and Mary Wollstonecraft and Jean Jacques Rousseau, on the other, in the conception of inequality and its origins. All three make two important claims that characterize their accounts of inequality: first, that inequality is not natural, and second, that the differences which are alleged to justify inequality are in fact produced by the inequality. These two claims distinguish one way of arguing for equality. I contrast this with another way of arguing for equality, one which acknowledges natural differences.

Résumé. Dans ce texte, je soutiens qu'il y a des similarités entre les conceptions de l'inégalité et de ses origines de Catharine MacKinnon d'une part et de Rousseau et Wollstonecraft d'autre part. Tous trois soutiennent deux thèses importantes qui caractérisent leur conception de l'inégalité : premièrement, l'inégalité n'est pas naturelle; deuxièmement, les différences qui sont invoquées pour justifier l'inégalité sont en fait le produit de cette inégalité. Ces deux positions sont distinctives d'une ligne d'argumentation défendant l'égalité. Je contraste cette ligne d'argumentation avec une seconde façon de défendre l'égalité qui diffère de la première en ce qu'elle reconnaît les différences naturelles.

Résumé. L'auteur entend défendre dans cet essai une conception de la sécession qu'il appelle délibérative et la justifier par rapport à d'autres théories concurrentes de la sécession. En l'absence d'un encadrement juridique clair et rigoureux des cas de sécession, de plus en plus nombreux, qui échappent aux situations de domination coloniale prévues par le droit international, la question se pose en effet de savoir s'il n'existe pas d'autres moyens de les résoudre dans des conditions pacifiques. L'auteur soutient que la démocratie délibérative pourrait offrir de tels moyens. Le but de l'article est d'examiner dans quelles conditions et à l'intérieur de quelles limites.

Abstract. In this article, the author aims at supporting a deliberative conception of secession and at justifying it against other rival theories. In the absence of clear and rigorous legal regulations of more and more numerous cases of secession going beyond the situations of colonial domination already covered by the international law, the question arises as to whether other means for their pacific solution are available. The author contends that deliberative democracy could provide such a means and examines in what conditions and within what limits this could be achieved.

Abstract. In the age of the Charter, courts are an important part of the policy process, and judicial independence is the concept that structures the interactions between courts and other institutions. Historically, judicial independence in Canada was modelled on (and little different from) that of England; but politically-led reforms in the 1970s, and a string of more than a dozen Supreme Court decisions centred on the 1997 Remuneration Reference, are transforming the concept. At the same time, a parallel string of cases extends more limited but essentially similar guarantees to some other administrative bodies. Together, these developments represent an important and enduring change in the Canadian political landscape.

À l'ère de la Charte, les tribunaux sont un élément important de l'élaboration des politiques publiques, et l'indépendance judiciaire est le fondement des interactions entre les tribunaux et les autres institutions. Par le passé, l'indépendance judiciaire au Canada épousait le modèle britannique (et s'en éloignait assez peu); cependant, des réformes politiquement inspirées dans les années 1970 et une série de plus d'une douzaine de jugements de la Cour suprême centrés sur le renvoi de 1997 relatif à la rémunération sont en train de transformer ce concept. En même temps, une série de cas parallèles accorde des garanties plus limitées mais très similaires à d'autres corps administratifs. Ces changements se conjuguent pour modifier considérablement et de façon permanente le paysage politique canadien.

Abstract. This paper argues that Foucault's proposed positive program of practical critique in his later work, which he calls ‘critical ontology,’ provides a response to his critics. The goal of critical ontology is to “separate out, from the contingency that has made us what we are, the possibility of no longer being, doing or thinking what we are, do, or think.” However, it may be objected that, since Foucault emphasizes going beyond contingencies, it appears that he is guilty of committing a kind of genetic fallacy. I will defend Foucault against such a charge by using concepts and practices in child development as an illustration. The example of child development is fitting for political theorizing because the development model of childhood is now central to the practices and policies of healthcare providers, social workers and educators. Such practices and policies aim to enhance the abilities of individuals to be both citizens and autonomous agents. Yet the effects of these policies on individuals are not always positive. The paper concludes with a discussion of the implications of critical ontology for practices grounded in the model of child development.

Cet article cherche à démontrer que le programme positif de critique pratique que Foucault propose dans ses derniers ouvrages, et qu'il qualifie d'une “ontologie critique,” constitue une réponse à ses détracteurs. Le but de cette ontologie critique est de dégager “de la contingence qui nous a fait être ce que nous sommes la possibilité de ne plus être, faire ou penser ce que nous sommes, faisons ou pensons”. Néanmoins, il est possible d'objecter que Foucault commet une sorte d'erreur génétique, puisqu'il insiste sur la nécessité de dépasser les contingences. Je cherche à defendre Foucault contre cette accusation en utilisant les concepts et pratiques du développement des enfants comme illustration. L'exemple du développement des enfants convient à la théorie politique puisque le modèle d'aménagement de l'enfance est maintenant au coeur des pratiques et des politiques de ceux qui travaillent dans les secteurs de la santé, de l'aide social, et de l'éducation. Telles pratiques et politiques ont comme but d'accroître la capacité des individus d'agir en même temps comme citoyens et des êtres autonomes. Pourtant, les effets de ces politiques sur des individus ne sont pas toujours bénéfiques. L'article se conclut par une analyse des implications d'une ontologie critique pour des pratiques fondées sur le modèle du développement des enfants.

Abstract. This article uses the recent Canadian campaign seeking redress for the infamous “Chinese head tax” as a vantage point from which to consider whether recognition-seeking social movements are undermining the cause of egalitarian redistribution. Methodologically, the article seeks to complement the normative theorizing and conceptual model-making that have tended to characterize the “recognition versus redistribution” debate by focusing more concretely on the dynamics of an actual social movement campaign. The article demonstrates how this approach can help to identify important nuances in recognition campaigns that blanket claims about recognition's impact both ignore and serve to obscure.

Résumé. Cet article étudie la récente campagne canadienne cherchant la réparation dans les cas d'application de l'infâme taxe d'immigration aux Canadiens d'origine chinoise. Cette campagne offre l'opportunité pour étudier si les mouvements sociaux militant pour la reconnaissance des situations d'abus perpétrées par le passé sont en train d'éroder la cause de la redistribution égalitaire. D'un point de vue méthodologique, l'article essaie de compléter la théoretisation normative et le developpement de modèles conceptuels qui ont seulement pris en compte le débat dit “ de la reconnaissance versus la redistribution ”, en se concentrant plus sur l'étude de la dynamique d'une campagne sociale contemporaine. L'article montre le fait que cette approche peut aider à mettre en exergue d'importants nuances dans les campagnes dites “ de la reconnaissance ”, que des études plus generaux sur l'impact de la reconnaissance ignorent.

Abstract. This article describes how the remembrance of historical events contributes to, and is shaped by, nationalism in Ireland and Quebec. Remembered historical events contribute to the growth of nationalism if they serve at least one of five purposes: defining the conceptual boundaries of the nation, reinforcing a sense of pride in the nation's achievements, evoking feelings of pity and indignation at the losses suffered by the nation, legitimizing the actions or principles of present-day leaders, or inspiring a belief that the nation will eventually triumph. Eight remembered events, four in Ireland and four in Quebec, are discussed in relation to these five purposes. The article concludes that historical remembrance has been a more powerful influence on nationalism in Ireland than in Quebec.

Résumé. Cet article raconte comment le souvenir des évenements historiques contribue au renforcement du nationalisme en Irlande et au Québec. Le souvenir d'un évenement historique aura cet effet s'il aide … definir la communauté nationale,s'il stimule des sentiments de la pitié et de l'indignation envers la nation et ses tribulations, s'il légitime les actions et les idées des nationalistes actuels, ou s'il encourage l'esperance que la nation va triompher contre ses adversaires. L'article examine quatre evenements historiques, irlandais ou québécois, avec le but de déterminer s'ils contribuent … ces cinq objectifs. Selon sa conclusion, l'influence des souvenirs historiques a été plus puissante en Irlande q'au Québec, ce qui explique la plus grande intensité du nationalisme irlandais.

Abstract. The gap between child care research and policy is growing in BC. While policy changes are what one would expect from the right-of-centre Liberal government, the gap runs contrary to its expressed commitment to the design of early childhood development policy on the basis of ‘science.’ The BC child care domain thus provides a rich context in which to examine how ideology mediates the consumption of research in the political arena. This article argues that the government's ‘choice’ discourse facilitates the articulation of neoliberal principles in a rhetorically neutral way while casting doubt on scholarship that illuminates gender and class inequalities.

Résumé. L'écart entre les recherches au sujet de soins d'enfant et la politique s'élargit en Colombie-Britannique. Pendant qu'on prévoit ces changements d'un gouvernement libéral droit-du-centre, l'écart dément son engagement de concevoir la politique de development de la petite enfance d'après la “science”. Ainsi la domaine de soins d'enfant en Colombie-Britannique fournit un contexte riche pour examiner comment l'idéologie s'interpose dans la consommation de recherches dans l'arène politique. Cet article soutient que la soi-disant dialogue de “choix” du gouvernement facilite l'articulation des principes néolibéraux d'une manière neutraliste pendant qu'on soulève du doute à l'érudition qui illumine des inégalités de genre et de classe sociale.

Abstract. Michel Foucault's late turn to ethics for an understanding of subject self-constitution is explored in relation to the problematic of humanism. Foucault's reconsideration of Immanuel Kant's Enlightenment-grounded legacy constitutes, it is argued, a significant resource for thinking about new ways to approach cultural practices that have as their aim a reconstitution of identity outside dominant structures of scientific and legal knowledge. This essay explores how Foucault's earlier anti-humanist misgivings give way to a more ethical-pragmatic conception of humanism in relation to notions of freedom, rights and equality. The insights of pragmatism—particularly those of John Dewey—are employed as a means by which to situate what is called here the “pragmatic humanism” of the later Foucault.

Résumé. Le tour en retard de Michel Foucault à l'éthique pour une compréhension d'individu-constitution soumise est exploré parrapport au problématique de l'humanisme. La reconsidération de Foucault du legs d'Immanuel Kant publiant hors de l'éclaircissement constitue, il est discutée, une ressource importante pour penser à de nouvelles manières d'approcher les pratiques culturelles qui ont en tant que leur but une reconstitution des structures dominantes d'extérieur d'identité de la connaissance scientifique et légale. Explore comment des craintes plus tôt d'anti-humaniste de Foucault mènent à une conception moral-pragmatique d'humanisme par rapport aux notions de la liberté, des droites, et de l'égalité. Les perspicacités du pragmatisme—en particulier ceux de John Dewey—utilisé comme moyens par lesquels pour situer ce qui est s'appellent ici l'humanisme pragmatic du Foucault plus défunt.

Abstract. A literature has emerged in American voting studies noting a “marriage gap”—the propensity for married voters to support the Republican party. Using Canadian Election Study data, we establish the existence of a significant marriage gap in Canada. We also seek to determine if the marriage gap is driven by socio-demographic factors or attitudinal ones. We find that while socio-demographic factors contribute to the marriage gap, they explain relatively little variance. In probing the attitudinal basis of the marriage gap further, we find that married Canadians differ from the unwed very strongly on issues of moral traditionalism, but much less so on other issues that measure generalized conservatism.

Résumé. Des travaux sont apparus dans les études américaines sur le vote remarquant l'existence d'un “écart mariage” (marriage gap) – la tendance des électeurs mariés à soutenir le parti républicain. Utilisant des données sur les élections nationales canadiennes, nous établissons l'existence d'un écart significatif au Canada. Nous cherchons aussi à déterminer si ce phénomène est poussé par les facteurs socio-démographiques ou les facteurs d'attitude. Nous constatons que bien que les facteurs socio-démographiques contribuent à cet écart, ils n'expliquent que relativement peu de variation. En recherchant davantage la base attitudinale, nous constatons que les canadiens mariés diffèrent très fortement de ceux qui ne sont pas mariés sur les questions de traditionalisme moral, mais cependant beaucoup moins sur les questions de conservatisme géneral.

Abstract. This essay identifies a problem with the phronesis revival. Some revivalists argue that phronesis can serve as a response to the homogenizing influence of technology, maintaining the particulars of individuals and communities. However, by their own argument, technology denies the conditions or “educational backdrop” that the development and practice of phronesis requires.

Résumé. Cet essai identifie le problème de la renaissance du phronesis. Ces révisionnistes considèrent que le phronesis peut serviez de réponse à l'influence homogénéifiante de la technologie. Ils maintiennent la spécificité des individus et des communautés. Cependant, selon leur propre argumentation, la technologie nie les conditions ou la base éducationnelle nécessaires au développement et à la pratique du phronesis.

This book derives from a conference held by the Canadian Study of Parliament Group at which distinguished persons discussed the efforts for reform in Westminster style parliamentary democracies. Topics covered include: second chambers (the British House of Lords, South Africa); proportional representation (New Zealand); the role of the Crown (Australia); political rights and representation of aboriginal peoples (New Zealand and Canada); and federalism and devolution (Britain and Canada). An introduction and conclusion by the editors, and a useful chapter by Jennifer Smith on reform of the Canadian Parliament complete the book.

The Integrity Gap: Canada's Environmental Policy and Institutions, Eugene Lee and Anthony Perl, eds., Vancouver: UBC Press, 2003, pp. xi, 288.

This collection, which grew out of papers presented at a conference at the Sookyung Centre for Canadian Studies in Seoul in 1999, is one of a number of recent publications to call attention to a peculiar feature of Canadian environmental policy. In spite of our much publicized commitment to greenery at home and our hectoring criticism of other countries' environmental policies abroad, our own record, when closely examined, proves to be lamentable and is actually getting worse in comparison with our counterparts in the Organization for Economic Cooperation and Development (OECD). This yawning gulf between promise and performance is the “integrity gap” of Lee and Perl's title.

The Politics of Public Management: The HRDC Audit of Grants and Contributions, David A. Good, The Institute of Public Administration of Canada Series in Public Management and Governance; Toronto, University of Toronto Press, 2003, pp. 240

The literature in public administration in some ways suffers from not having more practitioners reflecting, writing and analyzing their experiences. Thus David Good's book analyzing the HRDC's so-called “billion dollar boondoggle” is a welcome contribution. His background as both a senior manager/executive within the Federal government and his academic credentials—a doctorate in policy and administration sets him apart—as a practitioner-academic. Good possesses the senior public manager's mind for detail and this book provides a clear account of the ebbing and flowing of events, beginning with the January 2000 release of HRDC's internal audit that implied a loss of a billion dollars, to the Auditor General's report of October that same year which, while critical of monitoring and reporting practices, concluded that only $85,000 was unaccounted for. The media and the opposition, at this point quickly lost interest.

Chrétien and Canadian Federalism, Politics and the Constitution, 1993–2003, Edward McWhinney, Vancouver: Ronsdale Press, 2003, pp. 220.

Edward McWhinney, a legal scholar and former professor of political science, sat as the Member of Parliament for Vancouver Quadra through much of the Chrétien period. The title of the book promises an examination of the Chrétien era in terms of its legacy for Canadian federalism and the constitution. Sadly, the book fails to deliver. Although the author is quick to insist that his work is not a “personal biography” (12), but rather an analysis framed through “participant observation,” the examination of the past decade's events is largely a form of political memoir, with little by way of a sustained analysis of Canadian federalism or the constitution.

C'est bien à une seconde Révolution tranquille que l'auteur-journaliste-essayiste Gil Courtemanche nous convie tout au long de ce petit essai au ton pamphlétaire, écrit dans l'euphorie consécutive au sommet de Porto Allegre. Démocratiser la démocratie, voilà la véritable finalité de cette seconde Révolution tranquille, qui, contrairement à la première, devra venir de la base.

Egalité hommes-femmes ? Le militantisme au Québec : le PQ et le PLQ, Evelyne Tardy (avec la collaboration de Rébecca Beauvais et André Bernard), Montréal, Collection science politique, Cahiers du Québec, Ed. Hurtubise, 2003, 222 p.

Lors des dernières élections québécoises du 14 avril 2003, la proportion de femmes élues a augmenté, avec trois femmes députées de plus, soit une représentation à hauteur de 30% contre 28% auparavant. Indéniablement, le pourcentage de femmes élues n'a cessé de progresser depuis le milieu des années 80, soit quarante ans après l'obtention du droit de vote. La représentation parlementaire des femmes au Québec dépasse ainsi largement la moyenne mondiale qui est de 14%. Néanmoins, la proportion d'élues peut paraître encore faible, sinon insuffisante, par rapport au vivier de militantes existant dans les partis (37% de femmes en moyenne) et de l'objectif idéal de parité. Analyste incontournable du rapport des Québécoises au politique et du militantisme féminin, Evelyne Tardy, dans son dernier ouvrage, tente d'expliquer cette sous-représentation des femmes parmi les candidats aux différentes élections, à la lumière, notamment, des propos tenus par les militants et militantes. Une telle analyse conduit à s'intéresser aux ressources potentielles en femmes politiques. En effet, si les militants et militantes agissent pour faire triompher leurs idées, ils n'ont pas forcément de responsabilité de direction. Ils se situent en quelque sorte entre l'amateur (ils s'initient à la politique) et le professionnel de la politique. C'est aux instances dirigeantes des partis qu'il revient de sélectionner ceux qui sont susceptibles de remplir des fonctions politiques. Seules les hypothèses relatives au fonctionnement des partis politiques ont dond été retenues pour cette recherche dont les auteurs ont considéré comme militant “ toute personne qui siégeait à un comité exécutif du parti, qu'il soit local, régional ou central, autrement dit toute personne qui était susceptible de se voir confier des responsabilités au sein du parti (27). ” Il n'en demeure pas moins que les militants se caractérisent aussi par une grande diversité et qu'une typologie plus fine aurait pu enrichir le propos. On aurait pu imaginer, par exemple, de distinguer le militant ponctuel, dont la mobilisation est fonction de l'enjeu, du militant engagé qui prend des responsabilités dans l'organisation (seul considéré ici a priori) et enfin le militant qui possède un mandat électif. Parallèlement aux militants et militantes de base, il aurait été intéressant également de s'intéresser aux personnalités féminines qui ont fait carrière dans ces partis, aux militantes devenues députées ou ministres, par exemple, à leur profil et à leur parcours au sein du parti, par rapport aux hommes, pour avoir une analyse différenciée des parcours d'exception et d'une éventuelle évolution des années 70 à aujourd'hui. On aurait ainsi dégagé les profils valorisés par chacun des partis politiques.

Still Counting: Women in Politics Across Canada, Linda Trimble and Jane Arscott, Peterborough, ON: Broadview Press, 2003. pp. xvi, 210

Numbers matter. This is Trimble and Arscott's fundamental message. The ratio of women in elected and appointed political posts to their proportion in the population at large is a measure of fairness in political representation that has obvious implications for women's impact on political processes and policy outcomes. Although Canadian in perspective, the authors draw international comparisons where appropriate and find Canada rather lacking. Perennial under-representation, despite marked improvements over the past three decades, is an evident problem and an issue worthy of investigation.

Feminist Perspectives on Canadian Foreign Policy, Claire Turenne Sjolander, Heather A. Smith and Deborah Steinstra, eds., Toronto: Oxford University Press, 2003, pp. xiv, 246

This timely must-read collection of fourteen essays is a welcomed addition to a growing body of feminist Canadian foreign policy literature. It is an accessible collection which challenges traditional Canadian foreign policy analyses (including feminist ones) by deploying feminist approaches and presenting feminist foreign policy (re-)formulations. Each author carefully explains relevant feminist theory or scholarship to link tightly their theoretical arguments with their case studies.

Welfare Hot Buttons: Women, Work, and Social Policy Reform, Sylvia Bashevkin, Toronto: University of Toronto Press, 2002, pp. viii, 188.

Welfare Hot Buttons raises important, and in some ways uncomfortable, questions. Its major argument, in comparing social policy reform in the United States, the United Kingdom and Canada, is that the conservative leaders (Ronald Reagan, George Bush Sr., Margaret Thatcher, John Major, Brian Mulroney, Kim Campbell) were, in their social policy reforms, less punitive, less restrictive and less obsessed with paid work than their post-conservative successors (Bill Clinton, Tony Blair, Jean Chrétien). This raises important questions about the importance of elections and of elected politicians. There were real expectations that, to take the Canadian example, electing Chrétien's Liberals was a major shift away from Mulroney's Conservatives yet, as Sylvia Bashevkin shows, this was not true in the vital policy area of social policy reform.

Imagining Interest in Political Thought: Origins of Economic Rationality, Stephen G. Engelmann, Durham and London: Duke University Press, 2003, pp. x, 194

This always fascinating but sometimes frustrating volume undertakes to trace the natural history of what its author calls neo-liberalism, meaning the kind of economic analysis and approach to governance practiced by such denizens of the Chicago school as Nobel Prize winner Gary Becker and appeals court Justice Richard Posner. A professor at the University of Illinois in Chicago, Engelmann contends that this mode of analysis grew out of a way of thinking that was brought to maturity by Jeremy Bentham but had already begun to take root in Cromwell's England.
