Summary
With clear emphasis on the self-autonomy of the individual and in common with the freedoms of opinion and of expression, liberty of movement is ‘an indispensable condition for the free development of a person’.
Article 12 principally differs from its regional counterparts in that it does not make express provision concerning the expulsion of a State’s own nationals, nor the mass expulsion of aliens (non-nationals). Article 13 though does specify the procedural guarantees that are to apply to an alien being expelled from a State.
