Reasons are given for doubting the currently fashionable thesis that economic growth and industrialisation in the case of England derived from establishing secure property rights after 1688. Customary and public rights remained at risk. Ancient arrangements often persisted far into Victorian times. Detailed evidence is presented of survivals and of illiquid features in the land market. Evidence is also given of endemic disputes over enclosure and tithes. Unlike some European countries, England failed to establish a land registry. Limited transactions probably reflected unwillingness to risk litigation. That unsatisfactory property rights did not, however, stifle growth is tribute to the underlying power of the market.

Despite the recent expansion in studies of medieval women, uncertainty surrounds their married lives due to the social and legal constraints that existed at that time. Here it is argued that feet of fines provide a lens, albeit partial, on the activities of married women who were effectively managing the disposal and inheritance of their landed estates. At the same time the importance to the purchaser of ensuring the lawful acquisition of the property is also observed. As a result, greater insights into married women and their property in the fourteenth and fifteenth centuries are obtained.

This article studies temporal variations in wealth levels and distribution in an Ottoman context during the eighteenth century. By analysing the probate estate inventories of the Muslim deceased in Kastamonu, located in north-central Anatolia, we demonstrate that real wealth levels generally declined over the course of the century. Our analysis also suggests that the economic conditions of poor men, if not women, deteriorated more so than those of the rich, fuelling growing inequality. The article explores the factors that contributed to these trends and discusses the relevance of our findings for long-term economic development patterns in the region from a comparative perspective.

This article explores the impact of parliamentary enclosure on the cultural life of English villages after 1750. It focuses on parish-sponsored vermin control, arguing that the popular ‘hunting’ sanctioned by parish vestries under Tudor legislation, and persisting into the early nineteenth century, created a highly participatory recreational culture which continued to exist under the radar of the game laws. Using a sample of parishes from the heavily enclosed county of Northamptonshire, the article demonstrates that this communal activity survived the reworking of the landscape by parliamentary enclosure, and that, by extension, the level of disruption to village cultural life was less than has been suggested.

In the early 1370s, when serfdom had all but disappeared in Flanders, Count Louis II resumed the collection of mortmain, a death fee usually paid only by those of servile status. In a region with a sophisticated financial system it is striking that rather than accepting payment in cash the Count's bailiffs secured personal items. In this paper it is argued that the Count was thereby taking advantage of a population dazed by the ravages of plague and by the on-going civil war between himself and a number of the towns within his territory. Traditional local bonds such as mortmain, extended and reinterpreted within a new constellation of power, enabled Flemish counts to turn a fee into a tax, highlighting their authority.

This study examines the policies applied to French immigrants in Aragon between 1635 and 1697, a period of economic decline and constant conflict between Spain and France. The commercial and tax measures imposed by the Spanish monarchy on French immigrants to support the war effort were opposed and constrained by Aragonese institutions, such as the Diputación or the Corte del Justicia de Aragón. After a period of debate the Aragonese Parliament developed an autonomous policy towards the end of the seventeenth century. In the interests of the Aragonese economy and elites, restrictions on migrants were lowered and revised, until they focused mainly on merchants. This legislation allowed immigrant flows to continue, but it could not counteract the decline of economic opportunities for the French in Aragon.

The quality of the statistical archives of the Don Army Territory for the period 1867–1916 offers a unique opportunity to compare the denominations present (Orthodox, Old Believers and Coreligionists, Catholics, Lutherans, Jews, Armenian-Gregorians, Lamaist Buddhists and Muslims) in a context of urbanisation, secularisation and industrialisation. The observance of religious interdicts varied between and within denominations depending on levels of urbanisation and the district considered. These contrasts reveal the segmentation of Don society, the constraints imposed by agrarian imperatives and military obligations, the differences in the economy and between town and country, and the advance of secularisation or persistence of tradition.

Traditionally a large role has been attributed to the spread of clocks and watches in fostering a ‘modern’ awareness of time. Yet, little research is available that empirically enables signs of growing time awareness to be linked to the distribution of time-keeping devices. In this article both these phenomena are brought together using two independent sets of evidence that permit the hypothesis that clocks and watches contributed to a heightened consciousness of time to be tested. While the ownership of clocks and watches was socially skewed, highly gendered and unevenly distributed over time, time awareness – as exemplified throughout numerous court cases – was essentially none of these.

Large, concentrated settlements known as ‘agro-towns’ abound across Southern Italy and other parts of the Mediterranean. The prevalence and persistence of these settlements are very curious but not yet well understood. Initially, scholars interpreted their development as stemming from Southern Italy's economic and social ‘backwardness’ and inequality. This view has now been challenged by scholarship which emphasises that the pre-industrial Mezzogiorno supported not only a dynamic economy but also a diverse array of institutional structures. By recourse to a comparative study within Apulia, this paper suggests that both interpretations are equally correct. ‘Agro-towns’ in Southern Italy were linked to the inequitable distribution of land, perpetuated over the long term, but the institutional origins of this inequality were both diverse and dynamic.

This article examines the nature of pauperism in the south and east of England during the time of the Old Poor Law by using census material from five predominately rural parishes in Oxfordshire between 1786 and 1832. The proportion of people receiving poor relief was calculated for each parish, together with the types of people receiving such relief. While pauperism was significant in some parishes, others had relatively low levels of people receiving relief, and groups of poor hit by traditional life-cycle poverty were still common. Previous notions of widespread pauperism in the south and east during this period may thus need to be revised, with greater acknowledgement of the influence of local factors.

Recently, several studies have cast new light on the relative roles of commerce and exchange in rural areas. This article examines the importance of extra-local trade in two contrasting regions of the nineteenth-century Flemish countryside, Oudenaarde and Saint-Nicolas. In the first region, the size distribution of holdings was such that market dependence was ‘mediated’; rural output circulated via reciprocal personal relationships. In the second region, market dependence was ‘unmediated’ and rural producers were more directly involved in the market. The article also highlights the complexity of the commercialisation of the countryside, and the need to move beyond the traditional opposing views that have long dominated the debate on the commercialisation of the countryside.

This article examines encounters of women with the criminal justice system in Wales during the century before the Courts of Great Sessions were abolished in 1830. Drawing on evidence from cases of sexual assault and homicide, it argues that women who killed were rarely convicted or punished harshly. A gendered discretion of sorts also acted against rape victims, as trials never resulted in conviction. Using violence as a lens, the paper reveals a distinctively Welsh approach to criminal justice, and offers quantitative evidence on which further comparative studies of the history of law and crime in England and Wales may be based.

This article studies social dynamics in the Catalan region of Girona during the second half of the eighteenth and the first half of the nineteenth centuries, using marriage contracts signed before a notary. The analysis of this source reveals the existence of important social and economic changes, especially among the lowest groups of rural society. Among these transformations, the increase in the real value of dowries – especially in the case of treballadors (literally labourers) – stands out particularly, as does the appearance of new labels applied to new social groups. However, these changes occurred without altering the basic aspects of marriage patterns of the different social groups, as indicated by the strong stability of levels of social and geographical endogamy.

This article uses data from the 1833 Factory Inquiry to assess male and female occupations and earnings in factory textile production. These data are contrasted with evidence drawn from various sources on male and female employment in domestic industry. The period from 1760 to 1850 was a time of dramatic change in the nature and location of textile production, with important consequences for women's work. Whilst economic factors explain many of the changes we see, gender ideology had a powerful effect on how the labour market operated, and this was increasingly the case over this period as the organisation of work became more formalised and hierarchical.

This article makes use of autobiographies and oral interviews in order to explore the lifestyles of the first generation of immigrants within one particular provincial Jewish community – the Gorbals in Glasgow – between 1890 and 1945. The experience of this generation of immigrants was characterised by diversity to an extent that was not true of the second generation. Thus, the community cannot be described in terms of either ‘assimilation’ or ‘separation’. Instead, an alternative description has been coined: ‘variegated acculturation’ in order to encompass the complexity of the lives of the immigrants.
